5.11 Belgium

While Belgian legislation does not explicitly protect employee privacy, provisions in the Civil Code and in employment contract law relating to employment regulate the means by which information may be collected. Section 1134 of the Belgian Civil Code requires good faith and mutual respect between the parties to a contract of employment. A 1990 Labour Court ruling determined that video surveillance of employees violated Article 16 of the Act respecting contracts of employment, because it was an infringement of the private life of workers.120 One commentator has argued that cameras may only be used to control access to the enterprise and to monitor complicated and dangerous production processes.121
