Convention concerning the International Commission for the Rhine (Berne Convention)

LE GOUVERNEMENT DE LA RÉPUBLIQUE FÉDÉRALE D'ALLEMAGNE,

LE GOUVERNEMENT DE LA RÉPUBLIQUE FRANÇAISE,

LE GOUVERNEMENT DU GRAND-DUCHÉ DE LUXEMBOURG,

LE GOUVERNEMENT DU ROYAUME DES PAYS-BAS,

LE GOUVERNEMENT DE LA CONFÉDÉRATION SUISSE,

ET LA COMMUNAUTÉ ÉCONOMIQUE EUROPÉENNE,

se référant à l'accord du 29 avril 1963 et à l'accord additionnel du 3 décembre 1976 concernant la Commission internationale pour la protection du Rhin contre la pollution;

considérant que la pollution chimique des eaux du Rhin menace sa faune et sa flore et a également des effets indésirables sur les eaux de la mer;

conscients des dangers susceptibles d'en résulter pour certaines utilisations des eaux du Rhin;

désireux d'améliorer la qualité des eaux du Rhin en vue de ces utilisations;

considérants que le Rhin sert à d'autres utilisations, notamment à la navigation et comme milieu récepteur d'eaux usées;

convaincus que l'action internationale pour la protection des eaux du Rhin contre la pollution chimique doit être appréciée en relation avec les autres efforts déployés pour la protection des eaux du Rhin, en particulier les efforts tendant à la conclusion de conventions contre la pollution par les chlorures et la pollution thermique, et que cette action fait partie des mesures progressives et cohérentes pour protéger les eaux douces et les eaux de mer contre la pollution;

considérant l'action entreprise par la Communauté économique européenne pour la protection des eaux, notamment dans le cadre de la directive du Conseil, du 4 mai 1976, concernant la pollution causée par certaines substances dangereuses déversées dans le milieu aquatique de la Communauté;

se référant aux résultats des conférences ministérielles, qui se sont tenues les 25 et 26 octobre 1972 à La Haye, les 4 et 5 décembre 1973 à Bonn et le 1er avril 1976 à Paris, au sujet de la protection du Rhin contre la pollution,

SONT CONVENUS DE CE QUI SUIT:

Article premier

1. Les parties contractantes, pour améliorer la qualité des eaux du Rhin, prennent, conformément aux dispositions suivantes, les mesures appropriées pour:

a) éliminer la pollution des eaux de surface du bassin du Rhin par les substances dangereuses incluses dans les familles et groupes de substances figurant à l'annexe I (ci-après dénommées «substances relevant de l'annexe I»). Elles se proposent d'atteindre, progressivement, l'élimination des rejets de ces substances en tenant compte des résultats des examens effectués par les experts concernant chacune d'entre elles, ainsi que des moyens techniques disponibles;

b) réduire la pollution des eaux du Rhin par les substances dangereuses incluses dans les familles et groupes de substances figurant à l'annexe II (ci-après dénommées «substances relevant de l'annexe II»).

2. Les mesures visées au paragrafe 1 ci-dessus sont prises en tenant compte, dans une mesure raisonnable, de ce que les eaux du Rhin sont utilisées aux fin suivantes:

a) La production d'eau d'alimentation en vue de la consommation humaine;

b) la consommation par les animaux domestiques et sauvages;

c) la conservation et la mise en valeur des espèces naturelles pour ce qui est tant de la faune que de la flore et la conservation du pouvoir auto-épurateur des eaux;

d) la pêche;

e) les fins récréatives, compte tenu des exigences de l'hygiène et de l'esthétique;

f) les apports directs ou indirects d'eaux douces aux terres à des fins agricoles;

g) la production d'eau à usage industriel;

et la nécessité de préserver une qualité acceptable des eaux de mer.

3. Les dispositions de la présente convention ne constituent qu'un premier pas pour atteindre l'objectif visé au paragraphe 1 ci-dessus.

4. L'annexe A à la convention précise ce que les parties contractantes entendent par «Rhin» pour l'application de ladite convention.

Article 2

1. Les gouvernements, parties à la présente convention, font effectuer, pour leur usage, conformément aux dispositions du paragraphe 1 de l'annexe III, un inventaire national des rejets dans les eaux de surface du bassin du Rhin qui peuvent contenir des substances relevant de l'annexe I auxquelles des normes d'émission sont applicables.

2. Les gouvernements communiquent à la Commission internationale pour la protection du Rhin contre la pollution (ci-après dénommée «la Commission internationale»), conformément aux dispositions du paragraphe 2 de l'annexe III, les éléments de leur inventaire mis à jour régulièrement et au moins tous les trois ans.

3. Les propositions de la Commission internationale prévues au paragraphe 3 de l'article 6 peuvent comprendre, si nécessaire, un inventaire de diverses substances relevant de l'annexe II.

Article 3

1. Tout rejet effectué dans les eaux de surface du bassin du Rhin, susceptible de contenir l'une des substances relevant de l'annexe I, est soumis à une autorisation préalable délivrée par l'autorité compétente du gouvernement concerné.

2. Pour les rejets de ces substances dans les eaux de surface du bassin du Rhin et, lorsque cela est nécessaire aux fins de l'application de la présente convention, pour les rejets de ces substances dans les égouts, l'autorisation fixe des normes d'émission qui ne peuvent dépasser les valeurs limites fixées conformément à l'article 5.

3. En ce qui concerne les rejets existants de ces substances, l'autorisation fixe un délai pour le respect des conditions qu'elle prévoit. Ce délai ne peut excéder les limites fixées conforméments au paragraphe 3 de l'article 5.

4. L'autorisation ne peut être accordée que pour une durée limitée. Elle peut être renouvelée compte tenu des éventuelles modifications des valeurs limites visées à l'article 5.

Article 4

1. Les normes d'emission fixées par les autorisations délivrées en application de l'article 3 déterminent:

a) la concentration maximale admissible d'une substance dans les rejets. En cas de dilution, la valeur limite prévue au paragraphe 2 sous a) de l'article 5 est à diviser par le facteur de dilution;

b) la quantité maximale admissible d'une substance dans les rejets pendant une ou plusieurs périodes déterminées. Si nécessaire, cette quantité maximale peut, en outre, être exprimée en unité de poids du polluant par unité d'élément caractéristique de l'activité polluante (par exemple, unité de poids par matière première ou par unité de produit).

2. Si l'auteur du rejet déclare qu'il n'est pas en mesure de respecter les normes d'émission imposées, ou si l'autorité compétente du gouvernement concerné constate cette impossibilité, l'autorisation est refusée.

3. Si les normes d'émission ne sont pas respectées, l'autorité compétente du gouvernement concerné prend toutes les mésures utiles pour faire en sorte que les conditions de l'autorisation soient remplies et, si nécessaires, que le rejet soit interdit.

Article 5

1. La Commission Internationale propose les valeurs limites prévues au paragraphe 2 de l'article 3 et, si nécessaire, leur application aux rejets dans les égouts. Ces valeurs limites sont fixées conformément à la procédure prévue à l'article 14. Après leur adoption, elles sont incluses dans l'annexe IV.

2. Ces valeurs limites sont définies:

a) par la concentration maximale admissible d'une substance dans les rejets

et, si cela est approprié,

b) par la quantité maximale admissible d'une telle substance, exprimée en unité de poids du polluant par unité d'élément caractéristique de l'activité polluante (par exemple, unité de poids par matière première ou par unité de produit).

Si cela est approprié, les valeurs lilites applicables aux effluents industriels sont fixées par secteur et par type de produit.

Les valeurs limites applicables aux substances relevant de l'annexe I sont déterminées principalement sur la base:

- de la toxicité,

- de la persistance,

- de la bioaccumulation,

en tenant compte des meilleurs moyens techniques disponibles.

3. La Commission internationale propose aux parties contractantes les limites des délais visées au paragraphe 3 de l'article 3 en fonction des caractéristiques propres aux secteurs industriels concernés et, le cas échéant, aux types de produit. Ces limites sont fixées conformément à la procédure prévue à l'article 14.

4. La Commission internationale utilise les résultats obtenus aux points de mesure internationaux pour évaluer dans quelle mesure la teneur des eaux du Rhin en substances relevant de l'annexe I varie après application des dispositions précédentes.

5. La Commission internationale peut, si nécessaire, du point de vue de la qualité des eaux du Rhin, proposer d'autres mesures destinées à réduire la pollution des eaux du Rhin, en tenant compte notamment de la toxicité, de la persistance et de la bioaccumulation de la substance considérée. Ces propositions sont adoptées conformément à la procédure prévue à l'article 14.

Article 6

1. Tout rejet de l'une des substances relevant de l'annexe II, susceptible d'affecter la qualité des eaux du Rhin, doit faire l'objet d'une réglementation par les autorités nationales aux fins d'une limitation sévère.

2. Les gouvernements, parties à la présente convention, s'efforcent d'établir, dans un délai de deux ans à compter de l'entrée en vigueur de la présente convention, des programmes nationaux de réduction de la pollution des eaux du Rhin par les substances relevant de l'annexe II pour l'exécution desquels ils appliquent en particulier les moyens prévus aux paragraphes 1, 4, 5, 6 et 7 du présent article.

3. Les parties contractantes se concertent au sein de la Commission internationale préalablement à l'établissement de ces programmes nationaux. Dans ce but, la Commission internationale procède régulièrement à une comparaison des projets de programmes nationaux en vue d'assurer la cohérence des objectifs et des moyens de ces projets et présente des propositions en vue d'atteindre notamment des objectifs communs de réduction de la pollution des eaux du Rhin. Ces dernières propositions sont adoptées en application de la procédure prévue à l'article 14 de la présente convention. La comparaison des projets de programmes nationaux ne peut conduire à retarder la mise en oeuvre au niveau national ou régional des mesures destinées à réduire la pollution des eaux du Rhin.

4. Tout rejet susceptible de contenir l'une des substances relevant de l'annexe II est soumis à une autorisation préalable délivrée par l'autorité compétente du gouvernement concerné et fixant les normes d'émission. Celles-ci sont déterminées en fonction des objectifs de qualité prévus au paragraphe 5.

5. Les programmes visés au paragraphe 2 ci-dessus comprennent des objectis de qualité pour les eaux du Rhin.

6. Les programmes peuvent également contenir des dispositions spécifiques relatives à la composition et à l'emploi de substances ou groupes de substances ainsi que de produit, et tiennent compte des derniers progrès techniques économiquement réalisables.

7. Les programmes fixent les délais de leur mise en oeuvre.

8. Les programmes et les résultats de leur application sont communiqués à la Commission internationale sous forme résumée.

Article 7

1. Les parties contractantes prennent toutes les mesures législatives et réglementaires garantissant que la mise en dépôt des substances relevant des annexes I et II soit effectuée de telle manière qu'il n'y ait pas de menace de pollution pour les eaux du Rhin.

2. La Commission internationale propose, si nécessaire, aux parties contractantes des mesures appropriées relatives à la protection des eaux souterraines en vue de prévenir la pollution des eaux du Rhin par les substances relevant des annexes I et II.

Article 8

1. Les parties contractantes veillent à ce que les rejets soient contrôlés en application de la présente convention.

2. Elles informent annuellement la Commission internationale des expériences acquises.

Article 9

L'application des mesures prises en vertu de la présente convention ne peut en aucun cas avoir pour effet de permettre d'accroître directement ou indirectement la pollution des eaux du Rhin.

Article 10

1. En vue de contrôler la teneur des eaux du Rhin en substances relevant des annexes I et II, chaque gouvernement concerné prend à sa charge aux stations de mesure convenues sur le Rhin l'installation et le fonctionnement d'appareils et de systèmes de mesure, servant à déterminer la concentration desdites substances.

2. Chaque gouvernement concerné informe régulièrement, au moins une fois par an, la Commission internationale des résultats de ces contrôles.

3. La Commission internationale rédige un rapport annuel résumant les résultats des contrôles et permettant de suivre l'évolution de la qualité des eaux du Rhin.

Article 11

Lorsqu'un gouvernement, partie à la présente convention, constate dans les eaux du Rhin un accroissement soudain et notable des substances relevant des annexes I et II ou a connaissance d'un accident dont les conséquences sont susceptibles de menacer gravement la qualité de ces eaux, il en informe sans retard la Commission internationale et les parties contractantes susceptibles d'en être affectées selon une procédure à élaborer par la Commission internationale.

Article 12

1. Les parties contractantes informent régulièrement la Commission internationale de leurs expériences acquises lors de l'application de la présente convention.

2. La Commission internationale formule, le cas échéant, des recommandations, afin d'améliorer progressivement l'application de cette convention.

Article 13

La Commission internationale élabore des recommandations en vue d'atteindre des résultats comparables par l'emploi de méthodes appropriées de mesures et d'analyses.

Article 14

1. Les annexes I à IV qui font partie intégrante de la présente convention peuvent être modifiées et complétées en vue de les adapter au développement scientifique et technique ou d'améliorer l'efficacité de la lutte contre la pollution chimique des eaux du Rhin.

2. À cette fin, la Commission internationale recommande les modifications ou compléments qui lui paraissent utiles.

3. Les textes modifiés ou complétés entreront en vigueur après adoption unanime par les parties contractantes.

Article 15

Tout différend entre des parties contractantes relatif à l'interprétation ou à l'application de la présente convention et qui n'aura pu être réglé par voie de négociation est, sauf si les parties au différend en disposent autrement, soumis, à la requête de l'une d'entre elles, à l'arbitrage conformément aux dispositions de l'annexe B qui fait partie intégrante de la présente convention.

Article 16

Pour l'application de la présente convention, la Communauté économique européenne et ses États membres agissent dans les domaines relevant de leurs compétences respectives.

Article 17

1. Chaque partie signataire notifiera au gouvernement de la Confédération suisse l'exécution des procédures requises en ce qui la concerne pour l'entrée en vigueur de la présente convention.

2. Sous réserve de la notification par chaque partie de l'accomplissement des procédures requises pour l'entrée en vigueur de l'accord additionnel à l'accord concernant la Commission internationale pour la protection du Rhin contre la pollution, la présente Convention entrera en vigueur le premier jour du deuxième mois suivant la réception de la dernière notification prévue au paragraphe précédent.

Article 18

À l'expiration d'un délai de trois ans après son entrée en vigueur, la présente convention pourra être dénoncée à tout moment par chacune des parties contractantes par une déclaration adressée au gouvernement de la Confédération suisse. La dénonciation prendra effet, pour la partie qui dénonce, six mois après réception de la déclaration par le gouvernement de la Confédération suisse.

Article 19

Le gouvernement de la Confédération suisse informera les parties contractantes de la date de réception de toute notification ou déclaration reçue en application des articles 14, 17 et 18.

Article 20

1. Si l'accord du 29 avril 1963 concernant la Commission internationale pour la protection du Rhin contre la pollution est dénoncé par l'une des parties audit accord, les parties contractantes procéderont sans délai à des consultations au sujet des dispositions nécessaires en vue d'assurer la continuité de l'exécution des tâches qui, aux termes de la présente convention, incombent à la Commission internationale.

2. Si un accord n'est pas intervenu dans les six mois suivant l'ouverture des consultations, chacune des parties contractantes pourra dénoncer à tout moment la présente convention, conformément à l'article 18, sans attendre l'expiration du délai de trois ans.

Article 21

La présente convention, rédigée en un exemplaire unique, en langues allemande, française et néerlandaise, les trois textes faisant également foi, sera déposée dans les archives du gouvernement de la Confédération suisse qui en remettra une copie certifiée conforme à chacune des parties contractantes.

ANNEXE A

Pour l'application de la présente convention, le Rhin commence à la sortie du Lac inférieur et il inclut les bras, jusqu'à la ligne côtière, par lesquels il écoule librement ses eaux dans la mer du Nord, y compris l'Ijssel jusqu'à Kampen.

Dans l'établissement des programmes nationaux prévus à l'article 6 de la convention, en ce qui concerne les objectifs de qualité et la coordination des programmes qui sera faite au sein de la Commission internationale, il sera, selon les cas, tenu compte de la distinction entre eaux douces et eaux saumâtres du fleuve.

ANNEXE B

ARBITRAGE

1. À moins que les parties au différend n'en disposent autrement, la procédure d'arbitrage est conduite conformément aux dispositions de la présente annexe.

2. Le tribunal arbitral est composé de trois membres. Chacune des parties au différend nomme un arbitre. Les deux arbitres ainsi nommés désignent d'un commun accord le troisième arbitre qui assume la présidence du tribunal.

Si, au terme d'un délai de deux mois à compter de la désignation du deuxième arbitre, le président du tribunal n'a pas été désigné, le président de la Cour européenne des droits de l'homme procède, à la requête de la partie la plus diligente, dans un nouveau délai de deux mois, à sa désignation.

3. Si, dans un délai de deux mois après la reception de la requête prévue à l'article 15 de la convention, l'une des parties au différend n'a pas procédé à la désignation qui lui incombe d'un membre du tribunal, l'autre partie peut saisir le président de la Cour européenne des droits de l'homme qui désigne le président du tribunal arbitral dans un nouveau délai de deux mois. Dès sa désignation le président du tribunal demande à la partie qui n'a pas nommé d'arbitre de le faire dans un délai de deux mois. Passé ce délai, il saisit le président de la Cour européenne des droits de l'homme qui procède à cette nomination dans un nouveau délai de deux mois.

4. Si, dans les cas visés aux paragraphes précédents, le président de la Cour européenne des droits de l'homme se trouve empêché ou s'il est le ressortissant de l'une des parties au différend, la désignation du président du tribunal arbitral ou la nomination de l'arbitre incombe au vice-président de la Cour ou au membre le plus ancien de la Cour qui ne se trouve pas empêché et qui n'est pas le ressortissant de l'une des parties au différend.

5. Les dispositions qui précèdent s'appliquent, selon le cas, pour pouvoir aux sièges devenus vacants.

6. Le tribunal arbitral décide, selon les règles du droit international et, en particulier, selon les dispositions de la présente convention.

7. Les décisions du tribunal arbitral, tant sur la procédure que sur le fond, sont prises à la majorité des voix des ses membres, l'absence ou l'abstention d'un des membres du tribunal désignés par les parties n'empêchant pas le tribunal de statuer. En cas de partage égal des voix, la voix du président lient les parties. Celles-ci supportent les frais de l'arbitre qu'elles ont désigné et se partagent à part égale les autres frais. Sur les autres points, le tribunal arbitral règle lui-même sa procédure.

8. En cas de différend entre deux parties contractantes dont une seule est un État membre de la Communauté économique européenne, elle-même partie contractante, l'autre partie adresse la requête, à la fois à cet État membre et à la Communauté, qui lui notifient conjointement, dans un délai de deux mois après la réception de la requête, si l'État membre, la Communauté ou l'État membre et la Communauté conjointement se constituent partie au différend. À defaut d'une telle notification dans ledit délai, l'État membre et la Communauté sont réputés n'être qu'une seule et même partie au différend pour l'application des dispositions de la présente annexe. Il en est de même lorsque l'État membre et la Communauté se constituent conjointement partie au différend.

ANNEXE I

Familles et groupes de substances

L'annexe I comprend certaines substances individuelles qui font partie des familles et groupes de substances suivants, à choisir principalement sur la base de leur toxicité, de leur persistance, de leur bioaccumulation, à l'exception de celles qui sont biologiquement inoffensives ou qui se transforment rapidement en substances biologiquement inoffencives:

1. composés organo-halogénés et substances qui peuvent donner naissance à de tels composés dans le milieu aquatique,

2. composés organo-phosphoriques,

3. composés organo-stanniques,

4. substances dont il est prouvé qu'elles possèdent un pouvoir cancérigène dans le milieu aquatique ou par l'intermédiaire de celui-ci (1),

(1) Dans la mesure où certaines substances contenues dans l'annexe II ont un pouvoir cancérigène, elles sont incluses dans la catégorie 4 de la présente annexe.

5. mercure et composés du mercure,

6. cadmium et composés du cadmium,

7. huiles minérales persistantes et hydrocarbures d'origine pétrolière persistants.

ANNEXE II

Familles et groupes de substances

L'annexe II comprend:

- les substances qui font partie des familles et groupes de substances énumérés dans l'annexe I et pour lesquelles les valeurs limites visées à l'article 5 de la convention ne sont pas déterminées,

- certaines substances individuelles et certaines catégories de substances qui font partie des familles et groupes de substances énumérés ci-dessous,

et qui ont sur le milieu aquatique un effet nuisible qui peut cependant être limité à une certaine zone et qui dépend des caractéristiques des eaux de réception et de leur localisation.

Familles et groupes de substances visés au second tiret:

1. Métalloïdes et métaux suivants, ainsi que leurs composés:

1. zinc

2. cuivre

3. nickel

4. chrome

5. plomb

6. sélénium

7. arsenic

8. antimoine

9. molybdène

10. titane

11. étain

12. baryum

13. béryllium

14. bore

15. uranium

16. vanadium

17. cobalt

18. tallium

19. tellure

20. argent

2. Biocides

et leurs dérivés ne figurant pas dans l'annexe I;

3. Substances ayant un effet nuisible sur le goût et/ou sur l'odeur des produits de consommation de l'homme dérivés du milieu aquatique ainsi que les composés susceptibles de donner naissance à de telles substances dans les eaux;

4. Composés organo-siliciés toxiques ou persistants et substances qui peuvent donner naissance à de tels composés dans les eaux, à l'exclusion de ceux qui sont biologiquement inoffensifs ou qui se tranforment rapidement dans l'eau en substances inoffensives;

5. Composés inorganiques de phosphore et phosphore élémentaire;

6. Huiles minérales non persistantes et hydrocarbures d'origine pétrolière non persistants;

7. Cyanures, fluorures;

8. Substances exercant une influance défavorable sur le bilan d'oxygène, notamment:

ammoniaque, nitrites.

ANNEXE III

1. L'inventaire national prévu au paragraphe 1 de l'article 2 de la présente convention porte sur les déverseurs, les points de déversement, les substances déversées, classées selon leur caractère, et sur la quantité de ces substances.

2. Les éléments de l'inventaire visés au paragraphe 2 de l'article 2 de la convention portent sur les quantités globales respectives des différentes substances relevant de l'annexe I, déversées dans les eaux du bassin du Rhin entre les points de mesure proposés par la Commission internationale et acceptés par toutes les parties contractantes.

considérant que, en raison de ses compétences, il est nécessaire que la Communauté économique européenne denienne partie contractante à l'accord signé à Berne le 29 avril 1963,

SONT CONVENUS DE CE QUI SUIT:

Article premier

La Communauté économique européenne devient, à compter de la date d'entrée en vigueur du présent accord additionnel, partie à l'accord concernant la Commission internationale pour la protection du Rhin contre la pollution et au protocole de signature y annexé, signés à Berne le 29 avril 1963 (ci-après dénommés «l'accord»).

Article 2

L'accord est modifié comme suit:

a) L'expression «gouvernements signataires» est remplacée par l'expression «parties contractantes».

b) Le paragraphe 1 de l'article 4 est remplacé par le paragraphe suivant:

«1. Les modalités de l'exercice de la présidence de la Commission par les délégations sont déterminées par la Commission et sont insérées dans son règlement interieur; la délégation qui assume la présidence désigne un de ses membres comme président de la Commission».

c) Le paragraphe suivant est inséré dans l'article 6 après le paragraphe 1:

«2. Dans un domaine relevant de ses compétences, la Communauté économique européenne exerce son droit de vote avec un nombre de voix égal au nombre de ses États membres qui sont parties contractantes à l'accord. La Communauté économique européenne n'exerce pas son droit de vote dans les cas où ses États membres exercent le leur et inversement».

Le paragraphe 2 de l'article 6 devient le paragraphe 3 de l'article 6.

Le paragraphe 3 de l'article 6 devient le paragraphe 4 de l'article 6 et est complété comme suit:

«Toutefois, cette disposition ne s'applique pas à la délégation de la Communauté économique européenne».

d) Le paragraphe 2 de l'article 12 est remplacé par le paragraphe suivant:

«2. Les autres frais afférents aux travaux de la Commission sont répartis entre les parties contractantes de la manière suivante:

république fédérale d'Allemagne // 24,5 %

République française // 24,5 %

grand-duché de Luxembourg // 1,5 %

royaume des Pays-Bas // 24,5 %

Communauté économique européenne // 13 %

Confédération suisse // 12 %

tout ensemble // 100 %

La Commission peut aussi, dans certains cas, déterminer une autre répartition».

Article 3

1. La délégation qui exerce la présidence de la Commission lors de l'entrée en vigueur de l'accord additionnel continue à exercer cette présidence jusqu'à l'achèvement de son mandat de trois ans.

2. Les modalités de l'exercice ultérieur de la présidence de la Commission par les délégations sont, avant l'expiration du mandat visé au paragraphe précédent, déterminées par la Commission, compte tenu de sa nouvelle composition.

Article 4

1. Chaque partie signataire notifiera au gouvernement de la Confédération suisse l'exécution des procédures requises en ce qui la concerne pour l'entrée en vigueur du présent accord additionnel.

2. Le gouvernement de la Confédération suisse informera les parties contractantes de la date de réception relative à la protection du Rhin contre la pollution chimique.

Article 5

Le présent accord additionnel, rédigé en un exemplaire unique, en langues allemande, française et néerlandaise, les trois textes faisant également foi, sera déposé dans les archives du gouvernement de la Confédération suisse qui en remettra une copie certifiée conforme à chacune des parties contractantes.

OVEREENKOMST inzake de bescherming van de Rijn tegen chemische verontreiniging

DE REGERING VAN DE BONDSREPUBLIEK DUITSLAND,

DE REGERING VAN DE FRANSE REPUBLIEK,

DE REGERING VAN HET GROOTHERTOGDOM LUXEMBURG,

DE REGERING VAN HET KONINKRIJK DER NEDERLANDEN,

DE REGERING VAN DE ZWITSERSE BONDSSTAAT,

EN DE EUROPESE ECONOMISCHE GEMEENSCHAP,

Verwijzend naar de Overeenkomst van 29 april 1963 en de Aanvullende Overeenkomst van 3 december 1976 nopens de Internationale Commissie ter bescherming van de Rijn tegen verontreiniging,

Overwegende dat de chemische verontreiniging van het water van de Rijn de flora en de fauna hiervan bedreigt en tevens ongewenste uitwerkingen heeft op het zeewater,

Zich bewust van de gevaren die hieruit kunnen voortvloeien voor bepaalde gebruiksdoeleinden van het water van de Rijn,

Verlangend de kwaliteit van het water van de Rijn te verbeteren met het oog op deze gebruiksdoeleinden,

Overwegende dat de Rijn tevens voor andere doeleinden wordt gebruikt, met name voor de scheepvaart en voor het ontvangen van afvalwater,

Ervan overtuigd dat de internationale actie ter bescherming van het water van de Rijn tegen chemische verontreiniging moet worden beoordeeld in samenhang met de andere inspanningen ter bescherming van het water van de Rijn, in het bijzonder die inspanningen welke zijn gericht op het sluiten van overeenkomsten ter bestrijding van verontreiniging door chloriden en van thermische verontreiniging, en dat deze actie deel uitmaakt van de steeds voortgaande en samenhangende maatregelen om zoet water en zeewater te beschermen tegen verontreiniging,

Overwegende de actie ondernomen door de Europese Economische Gemeenschap ter bescherming van het water, met name in het kader van de richtlijn van de Raad van 4 mei 1976 betreffende de verontreiniging veroorzaakt door bepaalde gevaarlijke stoffen die in het aquatisch milieu van de Gemeenschap worden geloosd,

Verwijzend naar de resultaten van de ministersconferenties die op 25 en 26 oktober 1972 te Den Haag, op 4 en 5 december 1973 te Bonn en op 1 april 1976 te Parijs zijn gehouden over de bescherming van de Rijn tegen verontreiniging,

ZIJN OVEREENGEKOMEN ALS VOLGT:

Artikel 1

1. Ten einde de kwaliteit van het water van de Rijn te verbeteren, nemen de Overeenkomstsluitende Partijen, overeenkomstig de hierna volgende bepalingen, alle passende maatregelen om:

a) de verontreiniging van de oppervlaktewateren van het stroomgebied van de Rijn door de gevaarlijke stoffen die zijn begrepen onder de families en groepen van stoffen die worden genoemd in bijlage I (hierna te noemen de "onder bijlage I vallende stoffen") te beëindigen. Zij willen geleidelijk komen tot beëindiging van de lozingen van die stoffen, daarbij rekening houdend met de resultaten van de onderzoekingen die door deskundigen zijn verricht voor elk van die stoffen, alsook met de beschikbare technische middelen;

b) de verontreiniging van het water van de Rijn door de gevaarlijke stoffen die zijn begrepen onder de families en groepen van stoffen die worden genoemd in bijlage II (hierna te noemen de "onder bijlage I vallende stoffen") te verminderen.

2. Bij het nemen van de in het eerste lid van dit artikel bedoelde maatregelen wordt er in redelijke mate rekening mee gehouden dat het water van de Rijn wordt gebruikt voor de volgende doeleinden:

a) de bereiding van drinkwater voor menselijke consumptie,

b) consumptie door huisdieren en in het wild levende dieren,

c) het behoud en het onderhouden van de natuurlijke flora en fauna, alsmede het behoud van het zelfreinigend vermogen van het water,

d) visvangst,

e) recreatie, rekening houdend met de hygiënische en esthetische vereisten,

f) de directe of indirecte toevoer van zoet water naar het land voor agrarische doeleinden,

g) de produktie van water voor industriel gebruik,

en de noodzaak tot het behoud van een aanvaardbare kwaliteit van het zeewater.

3. Het bepaalde in deze Overeenkomst vormt slechts een eerste stap naar verwezenlijking van de in het eerste lid van dit artikel vervatte doelstelling.

4. Bijlage A van de Overeenkomst geeft een omschrijving van wat de Overeenkomstsluitende Partijen bij de toepassing daarvan onder "Rijn" verstaan.

Artikel 2

1. De Regeringen die partij zijn bij deze Overeenkomst laten, overeenkomstig het bepaalde in bijlage III, paragraaf 1, voor eigen gebruik een nationale lijst opstellen van de lozingen in de oppervlaktewateren van het stroomgebied van de Rijn, die stoffen kunnen bevatten, welke vallen onder bijlage I en waarop emissienormen van toepassing zijn.

2. De Regeringen delen aan de Internationale Commissie ter bescherming van de Rijn tegen verontreiniging (hierna te noemen "de Internationale Commissie") overeenkomstig het bepaalde in bijlage III, paragraaf 2, de gegevens mede van deze regelmatig en ten minste eenmaal per drie jaar bijgewerkte lijst.

3. De voorstellen van de Internationale Commissie bedoeld in artikel 6, derde lid, kunne zo nodig de opstelling omvatten van een lijst van verschillende onder bijlage II vallende stoffen.

Artikel 3

1. Voor elke lozing in de oppervlaktewateren van het stroomgebied van de Rijn, die een van de onder bijlage I vallende stoffen kan bevatten, is vooraf een vergunning nodig, die wordt verleend door de bevoegde autoriteit van de desbetreffende Regering.

2. Voor lozingen van deze stoffen in de opervlaktewateren van het stroomgebied van de Rijn en, wanneer zulks voor de toepassing van deze Overeenkomst noodzakelijk is, voor lozingen van deze stoffen in riolen, worden in de vergunning emissienormen vastgesteld, die de overeenkomstig artikel 5 vastgestelde grenswaarden niet mogen overschrijden.

3. Wat betreft de bestaande lozingen van deze stoffen, wordt in de vergunning een termijn bepaald voor de naleving van de hierin gestelde voorwaarden. Deze termijn mag de overeenkomstig artikel 5, derde lid, vastgestelde grenzen niet overschrijden.

4. De vergunning mag slechts worden verleend voor een beperkte duur. Zij kan worden vernieuwd met inachtneming van de eventuele wijzigingen van de grenswaarden bedoeld in artikel 5.

Artikel 4

1. In de emissienormen, vastgesteld in de vergunningen verleend uit hoofde van artikel 3, worden bepaald:

a) de in de lozingen toelaatbare maximumconcentratie van een stof. In geval van verdunning moet de in artikel 5, tweede lid, sub a), bedoelde grenswaarde worden gedeeld door de verdunningsfactor;

b) de in de lozingen toelaatbare maximumhoeveelheid van een stof tijdens één of meer vastgestelde perioden. Zo nodig kan deze hoeveelheid bovendien worden uitgedrukt in een gewichtseenheid van de verontreinigende stof per eenheid van het element dat kenmerkend is voor de verontreinigende werking (bijvoorbeeld per gewichtseenheid grondstof of per eenheid produkt).

2. Indien de lozer verklaart dat hij de opgelegde emissienormen niet in acht kan nemen, of indien de bevoegde autoriteit van de betrokken Regering zulks constateert, wordt de vergunning geweigerd.

3. Indien de emissienormen niet in acht worden genomen, neemt de bevoegde autoriteit van de betrokken Regering alle nodige maatregelen om ervoor te zorgen dat aan de voorwaarden van de vergunning wordt voldaan en dat, zo nodig, de lozing wordt verboden.

Artikel 5

1. De Internationale Commissie stelt de grenswaarden, bedoeld in artikel 3, tweede lid, voor en zo nodig de toepassing hiervan op lozingen in riolen. Deze grenswaarden worden vastgesteld overeenkomstig de in artikel 14 bepaalde procedure. Na aanneming worden zij opgenomen in bijlage IV.

2. Deze grenswaarden worden bepaald:

a) door de in de lozingen toelaatbare maximumconcentratie van een stof, en

b) indien dit past, door de toelaatbare maximumhoeveelheid van zulk een stof, uitgedrukt in een gewichtseenheid van de verontreinigende stof per eenheid van het element dat kenmerkend is voor de verontreinigende werking (bijvoorbeeld per gewichtseenheid grondstof of per eenheid produkt).

Indien dit past, worden de grenswaarden die op industrieel afvalwater van toepassing zijn, per sector en per type produkt vastgesteld.

De grenszaarden welke van toepassing zijn op de onder bijlage I vallende stoffen worden voornamelijk vastgesteld op basis van:

- de toxiciteit,

- de persistentie,

- de bioaccumulatie,

met inachtneming van de beste beschikbare technische middelen.

3. De Internationale Commissie stelt aan de Overeenkomstsluitende Partijen de in artikel 3, derde lid, bedoelde termijngrenzen voor, met inachtneming van de eigen kenmerken van de betrokken industriële sectoren en, in voorkomend geval, van de typen produkten. Deze grenzen worden vastgesteld overeenkomstig de in artikel 14 bepaalde procedure.

4.De Internationale Commissie gebruikt de resultaten die zijn verkregen op de internationale meetpunten om vast te stellen in welke mate het gehalte van de onder bijlage I vallende stoffen in het water van de Rijn verandert na toepassing van de voorgaande bepalingen.

5. De Internationale Commissie kan, zo nodig, vanuit het oogpunt van de kwaliteit van het water van de Rijn, andere maatregelen voorstellen, die zijn bestemd om de verontreiniging van het water van de Rijn te verminderen, rekening houdend met name met de toxiciteit, de persistentie in de bioaccumulatie van de betrokken stof. Deze voorstellen worden aangenomen overeenkomstig de in artikel 14 bepaalde procedure.

Artikel 6

1. Elke lozing van één van de onder bijlage II vallende stoffen, die van nadelige invloed kan zijn op de kwaliteit van het water van de Rijn, dient door de nationale autoriteiten te worden gereglementeerd, ten einde deze aanzienlijk te beperken.

2. De Regeringen die partij zijn bij deze Overeenkomst streven ernaar, binnen een termijn van twee jaar, te rekenen vanaf de inwerkingtreding van deze Overeenkomst, nationale programma's op te stellen tot beperking van de verontreiniging van het water van de Rijn door de onder bijlage II vallende stoffen; voor de uitvoering hiervan passen zijn in het bijzonder de in het eerste, vierde, zesde en zevende lid van dit artikel aangegeven middelen toe.

3. Alvorens deze nationale programma's vast te stellen, plegen de Overeenkomstsluitende Partijen binnen de Internationale Commissie onderling overleg ten einde deze programma's op elkaar af te stemmen. Hiertoe gaat de Internationale Commissie regelmatig over tot vergelijking van de ontwerpen van nationale programma's, ten einde te verzekeren dat er samenhang bestaat tussen de doelstellingen en de middelen van deze ontwerpen, en doet zij voorstellen ten einde met name gemeenschappelijke doelstellingen te verwezenlijken inzake vermindering van de verontreiniging van het water van de Rijn. Deze laatste voorstellen worden aangenomen volgens de in artikel 14 van deze Overeenkomst bepaalde procedure. De vergelijking van nationale ontwerp-programma's mag niet leiden tot vertraging in de tenuitvoerlegging op nationaal of regionaal niveau van maatregelen die zijn bestemd om de verontreiniging van het water van de Rijn te verminderen.

4. Voor iedere lozing die een van de onder bijlage II vallende stoffen kan bevatten, is een voorafgaande vergunning nodig, die door de bevoegde autoriteit van de betrokken Regering wordt verleend en waarin de emissienormen worden vastgesteld. Deze worden bepaald aan de hand van de in het vijfde lid aangegeven kwaliteitsdoelstellingen.

5. De in het tweede lid van dit artikel bedoelde programma's bevatten kwaliteitsdoelstellingen voor het water van de Rijn.

6. De programma's kunnen eveneens specifieke voorschriften bevatten, die op de samenstelling en het gebruik van stoffen of groepen van stoffen, alsmede produkten betrekking hebben; in de programma's wordt rekening gehouden met de jongste technische ontwikkelingen die economisch te verwezenlijken zijn.

7. In de programma's worden de termijnen vastgesteld voor de tenuitvoerlegging hiervan.

8. De programma's en de resultaten van de toepassing hiervan worden in beknopte vorm aan de Internationale Commissie medegedeeld.

Artikel 7

1. De Overeenkomstsluitende Partijen nemen alle wetgevende en administratieve maatregelen om te garanderen dat de opslag van de onder de bijlagen I en II vallende stoffen op zodanige wijze geschiedt, dat dit geen bedreiging inhoudt van verontreiniging van het water van de Rijn.

2. De Internationale Commissie stelt zo nodig aan de Overeenkomstsluitende Partijen passende maatregelen voor met betrekking tot de bescherming van het grondwater, ten einde te voorkimen dat het water van de Rijn wordt verontreinigd door de onder de bijlagen I en II valende stoffen.

Artikel 8

1. De Overeenkomstsluitende Partijen zien erop toe dat er krachtens deze Overeenkomst controle wordt uitgeoefend op de lozingen.

2. Zij delen eenmaal per jaar de door hen opgedane ervaringen aan de Internationale Commissie made.

Artikel 9

Toepassing van de krachtens deze Overeenkomst genomen maatregelen mag in geen geval direct of indirect toeneming van de verontreiniging van het water van de Rijn tot gevolg hebben.

Artikel 10

1. Ten einde controle uit te oefenen op het gehalte van onder de bijlagen I en II vallende stoffen in het water van de Rijn, neemt iedere betrokken Regering op de overeengekomen meetstations aan de Rijn, de installatie en het in bedrijf houden voor zijn rekening van meetapparaten en -systemen, die dienen om de concentratie van genoemde stoffen te bepalen.

2. Iedere betrokken Regering brengt regelmatig en ten minste eenmaal per jaar, de resultaten van deze controles ter kennis van de Internationale Commissie.

3. De Internationale Commissie stelt jaarlijks een verslag op, waarin de resultaten van deze controles worden samengevat en door middel waarvan de ontwikkeling van de kwaliteit van het water van de Rijn kan worden gevolgd.

Artikel 11

Wanneer een Regering die partij is bij deze Overeenkomst een plotselinge en aanzienlijke toeneming van onder de bijlagen I en II vallende stoffen in het water van de Rijn vaststelt, of wanneer zij kennis draagt van een ongeval, waarvan de gevolgen de kwaliteit van dit water ernstig kunnen bedreigen, stelt zij hiervan de Internationale Commissie en de Overeenkomstsluitende Partijen die hierdoor kunnen worden getroffen, onverwijld in kennis, volgens een door de Internationale Commissie vast te stellen procedure.

Artikel 12

1. De Overeenkomstsluitende Partijen stellen regelmatig de Internationale Commissie op de hoogte van de ervaringen die zij hebben opgedaan bij de toepassing van deze Overeenkomst.

2. In voorkomend geval stelt de Internationale Commissie aanbevelingen op voor een geleidelijke verbetering van de toepassing van deze Overeenkomst.

Artikel 13

De Internationale Commissie stelt aanbevelingen op om te komen tot vergelijkbare resultaten door het gebruik van passende methoden voor het verrichten van metingen en analyses.

Artikel 14

1. De bijlagen I tot en met IV, die een integrerend deel virmen van deze Overeenkomst, kunnen worden gewijzigd en aangevuld ten einde deze aan te passen aan de wetenschappelijke en technische ontwikkeling of de doeltreffendheid te verbeteren van de bestrijding van de chemische verontreiniging van het water van de Rijn.

2. Tot dit doel beveelt de Internationale Commissie die wijzigingen of aanvullingen aan, die haar nuttig lijken.

3. De gewijzigde of aangevulde teksten treden in werking nadat zij met eenparigheid van stemmen zijn aangenomen door de Overeenkomstsluitende Partijen.

Artikel 15

Ieder geschil tussen de Overeenkomstsluitende Partijen met betrekking tot de uitlegging of de toepassing van deze Overeenkomst dat niet door onderhandeling kan worden beslecht, wordt, tenzij de partijen bij het geschil anders beslissen, op verzoek van één van hen, voorgelegd aan een scheidsgerecht overeenkomstig de bepalingen van bijlage B bij deze Overeenkomst, die hiervan een integrerend deel vormt.

Artikel 16

Voor de toepassing van deze Overeenkomst treden de Europese Economische Gemeenschap en haar Lid-Staten op ter zake van de gebieden die vallen onder hun onderscheiden bevoegdheden.

Artikel 17

1. Elke ondertekenende Partij ieelt de Regering van de Zwitserse Bondsstaat mede wanneer aan de voor naar vereiste procedures voor de inwerkingtreding van deze Overeenkomst is voldaan.

2. Onder voorbehoud van de kennisgeving door elke Partij dat is voldaan aan de procedures, vereist voor de inwerkingtreding van de Aanvullende Overeenkomst bij de Overeenkomst nopens de Internationale Commissie ter bescherming van de Rijn tegen verontreiniging, treedt deze Overeenkomst in werking op de eerste dag van de tweede maand die volgt op de ontvangst van de laatste mededeling voorzien in het vorige lid.

Artikel 18

Na het verstrijken van een tijdvak van drie jaar na de inwerkingtreding van deze Overeenkomst, kan zij te allen tijde door elk van de Overeenkomstsluitende Partijen worden opgezegd, door middel van een mededeling aan de Regering van de Zwitserse Bondsstaat. De opzegging wordt voor de opzeggende Partij van kracht zes maanden na ontvangst van de mededeling door de Regering van de Zwitserse Bondsstaat.

Artikel 19

De Regering van de Zwitserse Bondsstaat stelt de Overeenkomstsluitende Partijen in kennis van de datum van ontvangst van elke mededeling die is ontvangen krachtens de artikelen 14, 17 en 18.

Artikel 20

1. Indien de Overeenkomst van 29 april 1963 nopens de Internationale Commissie ter bescherming van de Rijn tegen verontreiniging wordt opgezegd door één van de Partijen bij die Overeenkomst, treden de Overeenkomstsluitende Partijen onverwijld in overleg betreffende de maatregelen die nodig zijn om de continuïteit te verzekeren bij de uitvoering van de taken die ingevolge deze Overeenkomst rusten op de Internationale Commissie.

2. Indien binnen zes maanden na het begin van dit overleg geen overeenstemming is bereikt, kan elk der Overeenkomstsluitende Partijen te allen tijde deze Overeenkomst opzeggen, overeenkomstig artikel 18, zonder te wachten tot er een tijdvak van drie jaar is verstreken.

Artikel 21

Deze Overeenkomst, die is opgesteld in één exemplaar, in de Duitse, de Franse en de Nederlandse taal, zijnde de drie teksten gelijkelijk authentiek, zal worden nedergelegd in het archief van de Zwitserse Bondsstaat, die daarvan een voor eensluidend gewaarmerkt afschrift zal doen toekomen aan elk van de Overeenkomstsluitende Partijen.

BIJLAGE A

Voor de toepassing van deze Overeenkomst begint de Rijn bij de uitstroming uit het Bodenmeer en omvat de rivierarmen door welke hij vrijelijk in de Noordzee uitstroomt tot aan de kustlijn, met inbegrip van de IJssel tot aan Kampen.

Bij het opstellen van de in artikel 6 van de Overeenkomst bedoelde nationale programma's - voor zover het betreft de kwaliteitsdoelstellingen - alsook bij de coördinatie van deze programma's binnen de Internationale Commissie, zal van geval tot geval rekening worden gehouden met het onderscheid tussen het zoetwater- en het brakwatergedeelte van de rivier.

BIJLAGE B

SCHEIDSRECHTSPRAAK

1. Tenzij de partijen bij het geschil anders besluiten, wordt de scheidsrechterlijke procedure gevoerd met inachtneming van de bepalingen van deze bijlage.

2. Het scheidsgerecht bestaat uit drie leden: ieder der partijen bij het geschil wijst een scheidsman aan; de beide aldus aangewezen scheidsmannen wijzen in onderlinge overeenstemming de derde scheidsman aan, die het voorzitterschap van het gerecht op zich neemt.

Indien binnen twee maanden na de aanwijzing van de tweede scheidsman de voorzitter van het scheidsgerecht niet is aangewezen, gaat de President van het Europese Hof voor de Rechten van de Mens, op verzoek van de meest gerede partij binnen een volgende periode van twee maanden, over tot de benoeming.

3. Indien binnen twee maanden na de ontvangst van het verzoek bedoeld in artikel 15 van de Overeenkomst, één van de partijen bij het geschil niet is overgegaan tot de door haar te verrichten benoeming van een lid van het gerecht, kan de andere partij zich wenden tot de President van het Europese Hof voor de Rechten van de Mens, die de Voorzitter van het scheidsgerecht aanwijst binnen een volgende termijn van twee maanden. Zodra de Voorzitter van het scheidsgerecht is aangewezen, verzoek hij de partij die geen scheidsman heeft benoemd dit te doen binnen een termijn van twee maanden. Na het verstrijken van deze termijn, wendt hij zich tot de President van het Europese Hof voor de Rechten van de Mens, die binnen een volgende termijn van twee maanden overgaat tot de benoeming.

4. Indien in de in de voorgaande leden bedoelde gevallen de President van het Europese Hof voor de Rechten van de Mens verhinderd mocht zijn of indien hij onderdaan is van één van de partijen bij het geschil, dient de aanwijzing van de Voorzitter van het scheidsgerecht of de benoeming van de scheidsman te geschieden door de Vice-President van het Hof of door het in dienstjaren oudste lid van het Hof dat niet verhinderd is en dat geen onderdaan is van één van de partijen bij het geschil.

5. De voorgaande bepalingen zijn van overeenkomstige toepassing om in vacatures te voorzien.

6. Het scheiddsgerecht beslist overeenkomstig de regels van het internationale recht en, in het bijzonder, overeenkomstig de bepalingen van deze Overeenkomst.

7. Het scheidsgerecht beslist, zowel ten aanzien van de procedure als van de zaak zelf, met meerderheid van stemmen van zijn leden; wanneer één van de door partijen aangewezen leden van het gerecht niet aanwezig is of zich van stemming onthoudt, verhindert dit het gerecht niet uitspraak te doen. Indien de stemmen staken, is de stem van de Voorzitter doorslaggevend. De beslissingen van het gerecht zijn bindend voor de partijen. Deze dragen de kosten van de scheidsman die zij hebben aangewezen en verdelen de andere kosten gekijkelijk. Ten aanzien van de andere punten stelt het scheidsgerecht zelf zijn procedureregels vast.

8. In geval van een geschil tussen twee Overeenkomstsluitende Partijen, waarvan er één Lid-Staat is van de Europese Economische Gemeenschap, die zelf Overeenkomstsluitende Partij is, richt de andere Partij het verzoek zowel aan deze Lid-Staat als aan de Gemeenschap, die gezamenlijk binnen een termijn van twee maanden na ontvangst van het verzoek, aan die Partij ter kennis brengen of de Lid-Staat, de Gemeenschap, dan wel de Lid-Staat en de Gemeenschap gezamenlijk, partij zullen zijn bij het geschil. Indien een zodanige kennisgeving niet wordt gedaan binnen genoemde termijn, worden de Lid-Staat en de Gemeenschap voor de toepassing van het bepaalde in deze bijlage geacht één en dezelfde partij te vormen bij het geschil. Hetzelfde geldt wanneer de Lid-Staat en de Gemeenschap gezamenlijk partij zijn bij het geschil.

BIJLAGE I

Families en groepen van stoffen

Bijlage I omvat sommige afzonderlijke stoffen die deel uitmaken van de volgende families en groepen van stoffen die in hoofdzaak moeten worden gekozen op basis van hun toxiciteit, persistentie, bio-accumulatie, met uitzondering van die stoffen welke biologisch onschadelijk zijn of die snel worden omgezet in biologisch onschadelijke stoffen:

1. organische halogeenverbindingen en stoffen waaruit in water dergelijke verbindingen kunnen ontstaan;

2. organische fosforverbindingen;

3. organische tinverbindingen;

4. stoffen waarvan is aangetoond dat zij in of via het water een kankerverwekkende werking hebben (1);

(1) Voor zover sommige stoffen van bijlage II een kankerverwekkende werking hebben, zijn zij begrepen onder categorie 4 van deze bijlage.

5. kwik en kwikverbindingen;

6. cadmium en cadmiumverbindingen;

7. persistente minerale oliën en uit aardolie bereide persistente koolwaterstoffen.

BIJLAGE II

Families en groepen van stoffen

Bijlage II omvat:

- de stoffen die deel uitmaken van de families en groepen van stoffen genoemd in bijlage I en waarvoor de grenswaarden bedoeld in artikel 5 van de Overeenkomst niet worden vastgesteld,

- sommige afzonderlijke stoffen en bepaalde categorieën stoffen die deel uitmaken van onderstaande families en groepen van stoffen,

en die een schadelijke werking op het water hebben, welke echter beperkt kan zijn tot een bepaald gebied en afhangt van de kenmerken van de ontvangende wateren en de plaats daarvan.

Families en groepen van stoffen als bedoeld bij het tweede strepie:

4. Organische siliciumverbindingen die toxisch of persistent zijn en stoffen waaruit dergelijke verbindingen in het water kunnen ontstaan met uitzondering van die welke biologisch onschadelijke zijn of die in water snel worden omgezet in onschadelijke stoffen;

5. Anorganische fosforverbindingen en elementair fosfor;

6. Niet-persistente minerale oliën en uit aardolie bereide niet-persistente koolwaterstoffen;

7. Cyaniden;

Fluoriden;

8. Stoffen die ongunstig inwerken op de zuurstofbalans, met name:

Ammoniak,

Nitrieten.

BIJLAGE III

1. De in artikel 2, eerste lid, van deze Overeenkomst bedoelde nationale lijst, betreft de lozers, de lozingspunten, de geloosde stoffen ingedeeld naar hun aard, en de hoeveelheid van die stoffen.

2. De gegevens van de lijst, zoals die worden bedoeld in artikel 2, tweede lid, van de Overeenkomst, hebben betrekking op de onderscheiden globale hoeveelheden van de verschillende onder bijlage I vallende stoffen die worden geloosd in het water van het stroomgebied van de Rijn tussen de door de Internationale Commissie voorgestelde en door alle Overeenkomstsluitende Partijen aanvaarde meetpunten.

Gelet op de Overeenkomst nopens de Internationale Commissie ter bescherming van de Rijn tegen verontreiniging en het daaraan gehechte Protocol van ondertekening, die op 29 april 1963 te Bern zijn ondertekend,

Gelet op de Overeenkomst inzake de bescherming van de Rijn tegen chemische verontreiniging,

Overwegende dat het, vanwege de bevoegdheden van de Europese Economische Gemeenschap noodzakelijk is, dat zij Partij bij de op 29 april 1963 te Bern ondertekende Overeenkomst wordt,

ZIJN ALS VOLGT OVEREENGEKOMEN:

Artikel 1

De Europese Economische Gemeenschap wordt vanaf het tijdstip van inwerkingtreding van deze Aanvullende Overeenkomst Partij bij de Overeenkomst nopens de Internationale Commissie ter bescherming van de Rijn tegen verontreiniging en het daaraan gehechte Protocol van ondertekening, die op 29 april 1963 te Bern zijn ondertekend (hierna te noemen "de Overeenkomst").

Artikel 2

De Overeenkomst wordt als volgt gewijzigd:

a) De woorden "ondertekenende Regeringen" worden vervangen door de woorden "Overeenkomstsluitende Partijen".

b) Het eerste lid van artikel 4 wordt vervangen door het volgende lid:

"1. De modaliteiten van de uitoefening van het voorzitterschap van de Commissie door de delegaties worden bepaald door de Commissie en worden opgenomen in haar huishoudelijk reglement; de delegatie die het voorzitterschap uitoefent, wijst één van haar leden aan als voorzitter van de Commissie.".

c) In artikel 6 wordt na het eerste lid het volgende lid ingevoegd:

"2. Op de gebieden die onder haar bevoegdheid vallen, oefent de Europese Economische Gemeenschap haar stemrecht uit met een aantal stemmen dat gelijk is aan het aantal van haar Lid-Staten die Partij zijn bij de Overeenkomst. De Europese Economische Gemeenschap oefent haar stemrecht niet uit in alle gevallen waarin haar Lid-Staten hun stemrecht uitoefenen en omgekeerd.".

Artikel 6, tweede lid, wordt artikel 6, derde lid.

Artikel 6, derde lid, wordt artikel 6, vierde lid, en wordt als volgt aangevuld:

"Dit geldt echter niet voor de delegatie van de Europese Economische Gemeenschap.".

d) Artikel 12, tweede lid, wordt als volgt gelezen:

"2. De overige aan de werkzaamheden van de Commissie verbonden kosten worden in de volgende verhouding over de Overeenkomstsluitende Partijen omgeslagen:

Bondsrepubliek Duitsland // 24,5 %

Franse Republiek // 24,5 %

Groothertogdom Luxemburg // 1,5 %

Koninkrijk der Nederlanden // 24,5 %

Europese Economische Gemeenschap // 13 %

Zwitserse Bondsstaat // 12 %

De Commissie kan in bepaalde gevallen ook tot een andere verdeling besluiten.".

Artikel 3

1. De delegatie die het voorzitterschap van de Commissie uitoefent ten tijde van de inwerkingtreding van de Aanvullende Overeenkomst blijft dit voorzitterschap uitoefenen tot de afloop van zijn mandaat van drie jaar.

2. De modaliteiten van de verdere uitoefening van het voorzitterschap van de Commissie door de delegaties worden, vóór de afloop van het mandaat bedoeld in het vorige lid, bepaald door de Commissie, rekening houdend met haar nieuwe samenstelling.

Artikel 4

1. Elke ondertekenende Partij deelt de Regering van de Zwitserse Bondsstaat mede wanneer aan de voor haar vereiste procedures voor de inwerkingtreding van deze Aanvullende Overeenkomst is voldaan.

2. De Regering van de Zwitserse Bondsstaat stelt de Overeenkomstsluitende Partijen in kennis van de datum van ontvangst van deze mededelingen. Deze Aanvullende Overeenkomst treedt gelijktijdig in werking met de Overeenkomst inzake de bescherming van de Rijn tegen chemische verontreiniging.

Artikel 5

Deze Aanvullende Overeenkomst, opgesteld in één exemplaar, in de Duitse, de Franse en de Nederlandse taal, zijnde de drie teksten gelijkelijk authentiek, zal worden neergelegd bij de Regering van de Zwitserse Bondsstaat, die daarvan een gewaarmerkt afschrift zal doen toekomen aan elk van de Overeenkomstsluitende Partijen.

CONVENTION for the protection of the Rhine against chemical pollution

THE GOVERNMENT OF THE FEDERAL REPUBLIC OF GERMANY,

THE GOVERNMENT OF THE FRENCH REPUBLIC,

THE GOVERNMENT OF THE GRAND DUCHY OF LUXEMBOURG,

THE GOVERNMENT OF THE KINGDOM OF THE NETHERLANDS,

AND THE EUROPEAN ECONOMIC COMMUNITY,

Having regard to the Agreement of 29 April 1963 and the Additional Agreement of 3 December 1976 concerning the International Commission for the Protection of the Rhine against Pollution,

Whereas chemical pollution of the Rhine threatens its flora and fauna, and also has undesirable effects on sea water ;

Aware of the dangers that may result therefrom for certain uses of the waters of the Rhine ;

Desirous of improving the quality of Rhine water for these uses ;

Whereas the Rhine is used for other purposes such as navigation and as the receiving medium for waste waters ;

Convinced that international action for the protection of the Rhine against chemical pollution must be assessed in conjunction with other efforts to protect the Rhine, particularly efforts to conclude agreements against pollution by chlorides and thermal pollution, and that such action is one of the continuous and coherent measures to protect fresh water and sea water from pollution ;

Whereas the European Economic Community has taken measures to protect the aquatic environment, particularly within the framework of the Council Directive of 4 May 1976 on pollution caused by certain dangerous substances discharged into the aquatic environment of the Community ;

Having regard to the results of the Ministerial Conferences of 25 and 26 October 1972 in the Hague, 4 and 5 December 1973 in Bonn and 1 April 1976 in Paris on the Protection of the Rhine against Pollution,

HAVE AGREED AS FOLLOWS:

Article 1

1. The Contracting Parties shall, in accordance with the following provisions, take the appropriate measures, with a view to improving the quality of the waters of the Rhine, to:

(a) eliminate pollution of the surface waters of the Rhine basin by dangerous substances in the families and groups of substances appearing in Annex I (hereinafter referred to as' Annex I substances'). The purpose of the measures is to effect the gradual elimination of discharges of these substances, taking into account the findings of investigations carried out by experts separately for each one of them and the available technical means ;

(b) reduce the pollution of the Rhine by the dangerous substances in the families and groups of substances appearing in Annex II (hereinafter referred to as' Annex II substances').

2. The measures referred to in paragraph 1 above shall take into reasonable account the fact that Rhine water is used for:

(a) the production of drinking water for human consumption ;

(b) consumption by domestic and wild animals ;

(c) the conservation and development of the national species of flora and fauna and the preservation of the self-purifying capacity of water ;

(d) fishing ;

(e) recreational purposes, bearing in mind hygienic and aesthetic requirements ;

(f) the direct or indirect supply of fresh water to agricultural lands ;

(g) the production of water for industrial purposes, and the need to preserve an acceptable quality of sea water.

3. The provisions of this Convention shall constitute only an initial step towards the achievement of the objectives set out in paragraph 1.

4. Annex A to this Convention shall determine what the Contracting Parties mean by the word' Rhine' for the purposes of applying the said Convention.

Article 2

1. The Governments which are Parties to this Convention shall, pursuant to Annex III (1), establish for their own use a national inventory of discharges into the surface waters of the Rhine basin which may contain substances listed in Annex I, which are subject to emission standards.

2. Pursuant to Annex III (2), the Governments shall communicate to the International Commission for the Protection of the Rhine against Pollution (hereinafter referred to as the' International Commission') the contents of their inventories, which shall be regularly updated at intervals not exceeding three years.

3. The proposals of the International Commission provided for in Article 6 (3) may, if necessary, include an inventory of various substances falling under Annex II.

Article 3

1. Any discharge into the surface waters of the Rhine basin likely to contain a substance referred to in Annex I shall be subject to prior authorization from the responsible authorities of the Government concerned.

2. For discharges of these substances into the surface waters of the Rhine basin and, when necessary for the purpose of applying this Convention, for discharges of these substances into sewers, the authorization shall fix emission standards which may not exceed the limit values laid down in accordance with Article 5.

3. In the case of existing discharges of these substances, the authorization shall fix a time limit within which the conditions laid down in the authorization must be met. This time limit must not exceed the period laid down in accordance with Article 5(3).

4. The authorization may only be granted for a limited period of time. It may be renewed in the light of any alterations in the limit values referred to in Article 5.

Article 4

1. The emission standards laid down in the authorizations issued pursuant to Article 3 shall establish:

(a) the maximum permissible concentration of a substance in discharges. In cases where there is dilution, the limit value provided for in Article 5 (2) (a) shall be divided by the dilution factor ;

(b) the maximum permissible quantity of a substance in discharges during one or more specific periods. If necessary this quantity may also be expressed as a unit of weight of the pollutant per unit of the characteristic element of the polluting activity (e.g. unit of weight per unit of raw material or product unit).

2. If the discharger states that he is unable to conform to the emission standards or if the responsible authorities of the Government concerned establish this, authorization shall be refused.

3. If the emission standards are not observed, the responsible authorities of the Government concerned shall take all necessary measures to ensure that the conditions for the authorization are met and, if necessary, that the discharge is prohibited.

Article 5

1. The International Commission shall propose the limit values provided for in Article 3 (2) and if necessary their application to discharges into sewers. These limit values shall be laid down in conformity with the procedure provided for in Article 14. Upon adoption, they shall be included in Annex IV.

2. These limit values are fixed in terms of:

(a) the maximum permissible concentration of a substance in discharges and,

(b) where appropriate, the maximum permissible quantity of such a substance expressed as a unit of weight of the pollutant per unit of the characteristic element of the polluting activity (e.g. unit of weight per unit of raw material or product unit).

Where appropriate, the limit values applicable to industrial effluent shall be laid down individually by sector and by type of product.

The limit values applicable to Annex I substances shall be laid down mainly on the basis of:

- toxicity,

- persistence,

- bioaccumulation, taking into account the best available technical means.

3. The International Commission shall propose to the Contracting Parties the time limits referred to in Article 3 (3), making due allowance for the specific characteristics of the industrial sectors involved and, as appropriate, the types of product. These time limits shall be determined in accordance with the procedure laid down in Article 14.

4. The International Commission shall use the results obtained at international measuring points to determine the extent to which the level of Annex I substances in the Rhine varies following the application of the above provisions.

5. As regards the quality of Rhine water, the International Commission may if necessary propose other measures for reducing the pollution of the Rhine taking into account, inter alia, the toxicity, persistence and bioaccumulation of the substance under consideration. These proposals shall be adopted in accordance with the procedure laid down in Article 14.

Article 6

1. The discharge of any Annex II substance likely to affect the quality of Rhine water must be regulated by the national authorities with a view to limiting it strictly.

2. The Governments which are Parties to this Convention shall strive to establish, within a period of two years from the entry into force of this Convention, national programmes for the reduction of the pollution of the Rhine by Annex II substances for the implementation of which they shall apply, in particular, the means provided for in paragraphs 1, 4, 5, 6 and 7 of this Article.

3. Before drawing up their national programmes, the Contracting Parties shall confer within the International Commission. To this end, the International Commission shall regularly compare the draft national programmes in order to ensure that their aims and means coincide ; it shall submit proposals for achieving, inter alia, common goals in reducing pollution of the Rhine. These proposals shall be adopted by applying the procedure laid down in Article 14 of this Convention.

Comparison of draft national programmes should not entail delays in the implementation, at either national or regional level, of measures for reducing the pollution of the Rhine.

4. Any discharge which may contain an Annex II substance shall require prior authorization, laying down emission, standards, from the responsible authorities of the Government concerned. These standards shall be fixed in accordance with the quality objectives provided for in paragraph 5.

5. The programmes referred to in paragraph 2 above shall include quality objectives for Rhine water.

6. The programmes may also contain specific provision concerning the composition and use of substances or groups of substances and products ; they shall take into account the latest economically feasible technical advances.

7. The programmes shall lay down deadlines for their implementation.

8. Summaries of the programmes and the results of their implementation shall be communicated to the International Commission.

Article 7

1. The Contracting Parties shall take all legislative and administrative measures to ensure that the storage and deposit of Annex I and II substances is so carried out as to entail no danger of pollution to the Rhine.

2. If necessary, the International Commission shall propose to the Contracting Parties appropriate measures for protecting underground water in order to prevent pollution of the Rhine by Annex I and II substances.

Article 8

1. The Contracting Parties shall ensure that discharges are monitored in accordance with this Convention.

2. They shall inform the International Commission annually of the experience gained.

Article 9

Implementation of the measures taken pursuant to this Convention shall in no case result in a direct or indirect increase in the pollution of the Rhine.

Article 10

1. With a view to monitoring levels in the Rhine of Annex I and II substances, each Government concerned shall take responsibility at the agreed measuring station on the Rhine for installing and operating measuring systems and apparatus for determining the concentrations of such substances.

2. Every Government involved shall regularly inform the International Commission of the results of its monitoring, at least once a year.

3. The International Commission shall draft an annual report summarizing the monitoring results and enabling the progress of the quality of Rhine water to be observed.

Article 11

If a Government which is a Party to this Convention detects a sudden considerable increase in Annex I or II substances, or learns of an accident which could seriously threaten the quality of Rhine water, it shall inform the International Commission and the Contracting Parties which could be affected without delay and in accordance with a procedure to be worked out by the International Commission.

Article 12

1. The Contracting Parties shall regularly inform the International Commission of the experience gained in the course of implementing this Convention.

2. The International Commission shall also make recommendations, as appropriate, designed gradually to improve the implementation of this Convention.

Article 13

The International Commission shall work out draft recommendations for achieving comparable results by the use of appropriate measuring and analysis methods.

Article 14

1. Annexes I to IV inclusive, which shall form an integral part of this Convention, may be amended or added to for the purposes of adapting them to technical or scientific advances or of more effectively combating the chemical pollution of the Rhine.

2. To this end, the International Commission shall recommend the amendments or additions which it considers appropriate.

3. The amended or supplemented texts shall enter into force following unanimous acceptance by the Contracting Parties.

Article 15

Any dispute between the Contracting Parties concerning the interpretation or implementation of this Convention which cannot be settled by negotiation shall be submitted to arbitration unless the parties to the dispute decide otherwise and at the request of one of them, in accordance with the provisions of Annex B which shall form an integral part of this Convention.

Article 16

For the purposes of applying this Convention, the European Economic Community and its Member States shall act in their respective areas of competence.

Article 17

1. Each Signatory Party shall notify the Government of the Swiss Confederation of the completion of their procedures for bringing this Convention into force.

2. Subject to notification by each Contracting Party that the required procedures for the entry into force of the Additional Agreement to the Agreement concerning the International Commission for the Protection of the Rhine against Pollution have been completed, this Convention shall enter into force on the first day of the second month following receipt of the last notification provided for in the preceeding paragraph.

Article 18

Three years after its entry into force, this Convention may be denounced at any time by any of the Contracting Parties by means of a declaration transmitted to the Government of the Swiss Confederation. The denunciation shall become effective for the denouncing Party six months after the receipt by the Government of the Swiss Confederation of the declaration.

Article 19

The Government of the Swiss Confederation will inform the Contracting Parties of the date of receipt of any notification or declaration received in accordance with Articles 14, 17 and 18.

Article 20

1. If the Agreement of 29 April 1963 concerning the International Commission for the Protection of the Rhine against Pollution is denounced by one of its Contracting Parties, the Contracting Parties shall immediately consult with regard to the appropriate measures to be taken to ensure the continued performance of the duties which are encumbent on the International Commission pursuant to this Convention.

2. If agreement is not reached within six months of the opening of these consultations, any Contracting Party may at any time denounce this Convention in accordance with Article 18 without waiting for the expiry of the three-year time limit.

Article 21

This Convention, drawn up in a single original in the Dutch, French and German languages, all three texts being equally authentic, will be deposited in the archives of the Government of the Swiss Confederation, which will transmit a certified copy to each Contracting Party.

ANNEX A

For the purposes of implementing this Convention, the Rhine shall be taken as beginning at its outflow from the Untersee and including the arms, up to the coastline, through which its waters flow freely into the North Sea, inclusive of the Ijssel up to Kampen.

During the drawing-up of the national programmes provided for in Article 6 of the Convention - where quality objectives are concerned - and during the coordination of these programmes within the International Commission, a distinction shall be made in each separate case between the fresh water and the salt water of the river.

ANNEX B

ARBITRATION

1. Unless the parties to a dispute decide otherwise, the arbitration procedure shall be conducted in accordance with the provisions of this Annex.

2. The arbitral tribunal shall consist of three members ; each of the parties to the dispute shall appoint an arbitrator ; the two arbitrators so appointed shall by common consent designate a third who shall chair the tribunal.

If the chairman has not been appointed within two months of the designation of the second arbitrator, the President of the European Court of Human Rights shall, within a further two months, designate him at the request of the first party to act.

3. If, within two months of receipt of the request provided for in Article 15 of the Convention, one of the parties to the dispute has not designated an arbitrator, the other party may submit the matter to the President of the European Court of Human Rights who shall designate the chairman of the arbitral tribunal within a further two months. Once appointed, the chairman of the arbitral tribunal shall request the party which has not appointed an arbitrator to do so within two months. Upon expiry of this time limit, he shall submit the matter to the President of the European Court of Human Rights who shall make this appointment within a further two months.

4. If, in one of the cases referred to above, the President of the European Court of Human Rights is prevented from acting, or if he is a national of one of the parties to the dispute, the Vice-President of the Court or the most senior member of the Court who is not prevented from acting and who is not a national of one of the parties to the dispute shall appoint the chairman of the arbitral tribunal or an arbitrator.

5. These provisions shall apply, mutatis mutandis, to the filling of posts which have become vacant.

6. The arbitral tribunal shall decide on the basis of the rules of international law and in particular on the basis of the provisions of this Convention.

7. As regards both procedural and substantive matters, the arbitral tribunal shall decide by a majority of its members' votes ; the absence or abstention of one of the members of the tribunal appointed by the parties shall not prevent the tribunal from reaching a decision. In the case of parity of votes, the chairman shall have a casting vote. The decisions of the tribunal shall be binding on the parties. Each party shall bear the costs of the arbitrator appointed by it and shall share the other costs equally. For other matters, the arbitral tribunal shall establish its own rules of procedure.

8. In the case of a dispute between two Contracting Parties, only one of which is a Member State of the European Economic Community, which is itself a Contracting Party, the other party shall simultaneously transmit its request to that Member State and the Community, which shall jointly notify the party within two months following receipt of the request whether the Member State, the Community or the Member State and the Community together are parties to the dispute. If such notification is not given within the appointed time, both the Member State and the Community shall be regarded as constituting one and the same party to the dispute for the purposes of applying this Annex. The same shall obtain when the Member State and the Community are jointly a party to the dispute.

ANNEX I

Families and groups of substances

Annex I includes certain individual substances from the following families or groups of substances, selected mainly on the basis of their toxicity, persistence and bioaccumulation, with the exception of those which are biologically harmless or which are rapidly converted into substances which are biologically harmless.

1. Organohalogen compounds and substances which may form such compounds in the aquatic environment,

2. Organophosphorus compounds,

3. Organotin compounds,

4. Substances in respect of which it has been proved tht they possess carcinogenic properties in or via the aquatic environment (1).

(1) Where certain substances in Annex II are carcinogenic, they are included in category 4 of this Annex.

5. Mercury and its compounds,

6. Cadmium and its compounds,

7. Persistent mineral oils and hydrocarbons of petroleum origin.

ANNEX II

Families and groups of substances

Annex II contains:

- substances belonging to the families and groups in Annex I for which the limit values referred to in Article 5 of the Convention have not been determined,

- certain individual substances and categories of substances belonging to the families and groups of substances listed below, and which have a deleterious effect on the aquatic environment, which can, however, be confined to a given area and which depend on the characteristics and location of the water into which they are discharged.

Families and groups of substances referred to in the second indent:

1. The following metalloids and metals und their compounds:

3. Nickel

4. Chromium

5. Lead

6. Selenium

7. Arsenic

8. Antimony

9. Molybenum

10. Titanium

11. Tin

12. Barium

13. Beryllium

14. Boron

18. Thalium

19. Tellurium

20. Silver

2. Biocides and their derivatives not appearing in Annex I.

3. Substances which have a deleterious effect on the taste and/or smell of the products for human consumption derived from the aquatic environment, and compounds liable to give rise to such substances in water.

4. Toxic or persistent organic compounds of silicon and substances which may give rise to such compounds in water, excluding those which are biologically harmless or are rapidly converted in water into harmless substances.

5. Inorganic compounds of phosphorus and elemental phosphorus.

6. Non-persistent mineral oils and hydrocarbons of petroleum origin.

7. Cyanides, Fluorides.

8. Substances which have an adverse effect on the oxygen balance, in particular:

Ammonia,

Nitrites.

ANNEX III

1. The national inventory provided for in Article 2 (1) of this Convention shall show dischargers, points of discharge, and discharged substances classified according to type and quality.

2. The contents of the inventory referred to in Article 2 (2) of the Convention shall include the total quantities of each of the various substances set out in Annexe I, discharges into the waters of the Rhine basin between the measuring points proposed by the International Commission and accepted by all the Contracting Parties.

THE GOVERNMENT OF THE FEDERAL REPUBLIC OF GERMANY,

THE GOVERNMENT OF THE FRENCH REPUBLIC,

THE GOVERNMENT OF THE GRAND DUCHY OF LUXEMBOURG,

THE GOVERNMENT OF THE KINGDOM OF THE NETHERLANDS,

THE GOVERNMENT OF THE SWISS CONFEDERATION,

AND THE EUROPEAN ECONOMIC COMMUNITY,

Having regard to the Agreement, signed in Berne on 29 April 1963, concerning the International Commission for the Protection of the Rhine against Pollution and the Protocol of Signature annexed thereto,

Having regard to the Convention for the protection of the Rhine against chemical pollution,

Whereas, in view of its jurisdiction, the European Economic Community must become a Contracting Party to the Agreement signed in Berne on 29 April 1963,

HAVE AGREED AS FOLLOWS:

Article 1

The European Economic Community shall become a Contracting Party to the Agreement concerning the International Commission for the Protection of the Rhine against Pollution and the Protocol of Signature attached thereto (hereinafter referred to as 'the Agreement'), signed in Berne on 29 April 1963, from the date of the entry into force of this Additional Agreement.

Article 2

The following amendments shall be made to the Agreement:

(a) The term 'Signatory Governments' shall be replaced by 'Contracting Parties'.

(b) Article 4 (1) shall be replaced by the following:

1. Details regarding the exercise of the chairmanship of the Commission by the delegations shall be worked out by the Commission and included in its rules of procedure ; the delegation assuming the chairmanship shall designate one of its members as chairman of the Commission.'

(c) The following paragraph shall be inserted after Article 6 (1):

' 2. In those areas coming within its jurisdiction, the European Economic Community shall have the number of votes corresponding to the number of its Member States which are Contracting Parties to this Agreement. The European Economic Community shall not vote in cases where its Member States vote and vice versa.'

Article 6 (2) shall become Article 6 (3).

Article 6 (3) shall become Article 6 (4) ; the following words shall be added thereto:

' However, this provision shall not apply to the delegation of the European Economic Community.'

(d) Article 12 (2) shall be replaced by the following:

' 2. The remaining costs of the Commission' s activities shall be shared out among the Contracting Parties as follows:

Federal Republic of Germany // 24.5 %

French Republic // 24.5 %

Grand Duchy of Luxembourg // 1.5 %

Kingdom of the Netherlands // 24.5 %

European Economic Community // 13 %

Swiss Confederation // 12 %

Total // 100 %

In certain cases, the Commission may adopt a different distribution.'

Article 3

1. The delegation which holds the chair of the Commission at the time of the entry into force of the Additional Agreement shall continue to preside until its three-year period of office expires.

2. The details of the subsequent exercise of the chairmanship of the Commission by the delegations shall be worked out by the Commission in the light of its new composition and before the expiry of the period of office referred to in paragraph 1.

Article 4

1. Each Signatory Party will notify the Government of the Swiss Confederation of the completion of the procedures necessary for the entry into force of this Additional Agreement.

2. The Government of the Swiss Confederation will inform the Contracting Parties of the date of receipt of such notifications. This Additional Agreement shall enter into force at the same time as the Convention for the protection of the Rhine against chemical pollution.

Article 5

This Additional Agreement, drawn up in a single original in the Dutch, French and German languages, all three texts being equally authentic, will be deposited in the archives of the Government of the Swiss Confederation, which will transmit a certified copy to each Contracting Party.
