COUNCIL DECISION of 13 July 1981 concerning the conclusion of the Convention on Future Multilateral Cooperation in the North-East Atlantic Fisheries (81/608/EEC)

THE COUNCIL OF THE EUROPEAN COMMUNITIES,

Having regard to the Treaty establishing the European Economic Community, and in particular Article 43 thereof,

Having regard to the proposal from the Commission,

Having regard to the opinion of the European Parliament (1),

Whereas international cooperation and consultation are indispensable for the conservation and optimum use of the North-East Atlantic Fishery resources in waters outside the zones under the jurisdiction of the coastal States;

Whereas, to this end and with a view to replacing the North-East Atlantic Fisheries Convention of 24 January 1959, a new multilateral convention on the North-East Atlantic fisheries was negotiated ; whereas the Community took part in these negotiations;

Whereas, following the negotiations, the United Kingdom Government, as depositary, opened the new Convention for signature from 18 November 1980 to 28 February 1981;

Whereas Community fishermen work in parts of the Convention zone outside the zones under the jurisdiction of the coastal States, and whereas, therefore, it is in the Community's interest to join in the international cooperation on conservation and use of the resources in question by acceding to the new Convention,

HAS DECIDED AS FOLLOWS:

Article 1

The Convention on Future Multilateral Cooperation in the North-East Atlantic Fisheries is hereby approved on behalf of the European Economic Community.

The text of the Convention is attached to this Decision.

Article 2

The President of the Council shall deposit the instrument of approval with the Government of the United Kingdom of Great Britain and Northern Ireland, in accordance with Article 20 of the Convention (2).

CONVENTION on future multilateral cooperation in North-East Atlantic fisheries

THE CONTRACTING PARTIES,

NOTING that the coastal States of the North-East Atlantic have, in accordance with relevant principles of international law, extended their jurisdiction over the living resources of their adjacent waters to limits of up to two hundred nautical miles from the baselines from which the breadth of the territorial sea is measured, and exercise within these areas sovereign rights for the purpose of exploring and exploiting, conserving and managing these resources,

TAKING INTO ACCOUNT the work of the Third United Nations Conference on the Law of the Sea in the field of fisheries,

DESIRING to promote the conservation and optimum utilization of the fishery resources of the North-East Atlantic area within a framework appropriate to the régime of extended coastal state jurisdiction over fisheries, and accordingly to encourage international cooperation and consultation with respect to these resources,

CONSIDERING that the North-East Atlantic Fisheries Convention of 24 January 1959 should accordingly be replaced,

HAVE AGREED AS FOLLOWS:

Article 1

1. The area to which this Convention applies, hereinafter referred to as "the Convention area", shall be the waters: (a) within those parts of the Atlantic and Arctic Oceans and their dependent seas which lie north of 36º north latitude and between 42º west longitude and 51º east longitude, but excluding: (i) the Baltic Sea and the Belts lying to the south and east of lines drawn from Hasenore Head to Gniben Point, from Korshage to Spodsbierg and from Gilbierg Head to the Kullen, and

(ii) the Mediterranean Sea and its dependent seas as far as the point of intersection of the parallel of 36º latitude and the meridian of 5º 36' west longitude,

(b) within that part of the Atlantic Ocean north of 59º north latitude and between 44º west longitude and 42º west longitude.

2. This Convention applies to all fishery resources of the Convention area with the exception of sea mammals, sedentary species, i.e. organisms which, at the harvestable stage, either are immobile on or under the seabed or are unable to move except in constant physical contact with the seabed or the subsoil and, in so far as they are dealt with by other international agreements, highly migratory species and anadromous stocks.

Article 2

Nothing in this Convention shall be deemed to affect the rights, claims, or views of any Contracting Party with regard to the limits or extent of jurisdiction over fisheries.

Article 3

1. For the purposes of this Convention the Contracting Parties agree to establish and maintain a North-East Atlantic Fisheries Commission, hereinafter referred to as "the Commission".

2. The Commission shall have legal personality and shall enjoy in its relations with other international organizations and in the territories of the Contracting Parties such legal capacity as may be necessary to perform its functions and achieve its ends.

3. Each Contracting Party shall appoint to the Commission not more than two representatives who may be accompanied at any of its meetings by experts and advisers.

4. The Commission shall elect its own president and not more than two vice-presidents.

5. The office of the Commission shall be in London.

6. Except when the Commission determines otherwise, it shall meet once a year in London at such time as it decides ; provided, however, that upon the request of a Contracting Party and subject to the concurrence of three other Contracting Parties, the President shall, as soon as practicable, convene a meeting at such time and place as he may determine.

7. The Commission shall appoint its own secretary and such other staff as it may require.

8. The Commission may set up such committees and other subsidiary bodies as it considers desirable for the exercise of its duties and functions.

9. Each Contracting Party shall have one vote in the Commission. Decisions of the Commission shall be taken by a simple majority, or, if this Convention specifically requires a qualified majority, by a two-thirds majority of the votes of all Contracting Parties present and casting affirmative or negative votes, provided that no vote shall be taken unless there is a quorum of at least two-thirds of the Contracting Parties. If there is an even division of votes on any matter which is subject to a simple majority decision, the proposal shall be regarded as rejected.

10. Subject to the provisions of this Article, the Commission shall adopt its own Rules of Procedure, including provisions for the election of the president and vice-presidents and their terms of office.

11. Reports of the proceedings of the Commission shall be transmitted as soon as possible to the Contracting Parties in English and French.

Article 4

1. The Commission shall perform its functions in the interests of the conservation and optimum utilization of the fishery resources of the Convention area and shall take into account the best scientific evidence available to it.

2. The Commission shall provide a forum for consultation and exchange of information on the state of the fishery resources in the Convention area and on management policies, including examination of the overall effect of such policies on the fishery resources.

Article 5

1. The Commission shall, as appropriate, make recommendations concerning fisheries conducted beyond the areas under fisheries jurisdiction of Contracting Parties. Such recommendations shall be adopted by a qualified majority.

2. The Commission in the exercise of its functions under paragraph 1 shall seek to ensure consistency between: (a) any recommendation that applies to a stock or group of stocks occurring both within an area under the fisheries jurisdiction of a Contracting Party and beyond, or any recommendation that would have an effect through species inter-relationships on a stock or group of stocks occurring in whole or in part within an area under the fisheries jurisdiction of a Contracting Party, and

(b) any measures and decisions taken by such Contracting Party for the management and conservation of that stock or group of stocks with respect to fisheries conducted within the area under its fisheries jurisdiction.

The appropriate Contracting Party and the Commission shall accordingly promote the coordination of such recommendations, measures and decisions.

3. For the purpose of paragraph 2 each Contracting Party shall keep the Commission informed of its measures and decisions.

Article 6

1. The Commission may make recommendations concerning fisheries conducted within an area under fisheries jurisdiction of a Contracting Party, provided that the Contracting Party in question so requests and the recommendation receives its affirmative vote.

2. The Commission may give advice concerning fisheries referred to in paragraph 1 if the Contracting Party in question so requests.

Article 7

In the exercise of its functions, as set out in Articles 5 and 6, the Commission may consider inter alia measures for: (a) the regulation of fishing gear and appliances, including the size of mesh of fishing nets,

(b) the regulation of the size limits of fish that may be retained on board vessels, or landed or exposed or offered for sale,

(c) the establishment of closed seasons and of closed areas,

(d) the improvement and increase of fishery resources, which may include artificial propagation, the transplantation of organisms and the transplantation of young,

(e) the establishment of total allowable catches and their allocation to Contracting Parties,

(f) the regulation of the amount of fishing effort and its allocation to Contracting Parties.

Article 8

1. The Commission may by a qualified majority make recommendations concerning measures of control relating to fisheries conducted beyond areas under the fisheries jurisdiction of Contracting Parties for the purpose of ensuring the application of this Convention and any recommendations adopted thereunder.

2. The Commission may also make recommendations concerning measures of control relating to fisheries conducted within an area under the fisheries jurisdiction of a Contracting Party, provided that the Contracting Party in question so requests and the recommendation receives its affirmative vote.

3. Recommendations adopted under this Article may include provisions for termination different from those provided for in Article 13.

Article 9

1. The Commission may by a qualified majority make recommendations providing for the collection of statistical information relating to fisheries conducted beyond areas under the fisheries jurisdiction of Contracting Parties.

2. The Commission may also make recommendations providing for the collection of statistical information relating to fisheries conducted within an area under the fisheries jurisdiction of a Contracting Party, provided that the recommendation receives the affirmative vote of that Contracting Party.

Article 10

When adopting recommendations the Commission shall determine whether, and under which conditions, those recommendations shall apply to fishing operations conducted solely for the purpose of scientific investigation carried out according to relevant principles and rules of international law.

Article 11

1. The Commission shall, without undue delay, notify the Contracting Parties of the recommendations adopted by the Commission under this Convention.

2. The Commission may publish or otherwise disseminate reports of its activities and other information relating to the fisheries in the Convention area.

Article 12

1. A recommendation shall become binding on the Contracting Parties subject to the provisions of this Article and shall enter into force on a date determined by the Commission, which shall not be before 30 days after the expiration of the period or periods of objection provided for in this Article.

2. (a) Any Contracting Party may, within 50 days of the date of notification of a recommendation adopted under paragraph 1 of Article 5, under paragraph 1 of Article 8 or under paragraph 1 of Article 9, object thereto. In the event of such an objection, any other Contracting Party may similarly object within 40 days after receiving notification of that objection. If any objection is made within this further period of 40 days, other Contracting Parties are allowed a final period of 40 days after receiving notification of that objection in which to lodge objections.

(b) A recommendation shall not become binding on a Contracting Party which has objected thereto.

(c) If three or more Contracting Parties have objected to a recommendation it shall not become binding on any Contracting Party.

(d) Except when a recommendation is not binding on any Contracting Party according to the provisions of subparagraph (c), a Contracting Party which has objected to a recommendation may at any time withdraw that objection and shall then be bound by the recommendation within 70 days, or as from the date determined by the Commission under paragraph 1, whichever is the later.

(e) If a recommendation is not binding on any Contracting Party, two or more Contracting Parties may nevertheless at any time agree among themselves to give effect thereto, in which event they shall immediately notify the Commission accordingly.

3. In the case of a recommendation adopted under paragraph 1 of Article 6, under paragraph 2 of Article 8, or under paragraph 2 of Article 9, only the Contracting Party exercising fisheries jurisdiction in the area in question may, within 60 days of the date of notification of the recommendation, object thereto, in which case the recommendation shall not become binding on any Contracting Party.

4. The Commission shall notify the Contracting Parties of any objection and withdrawal immediately upon the receipt thereof, and of the entry into force of any recommendation and of the entry into effect of any agreement made pursuant to subparagraph (e) of paragraph 2.

Article 13

1. (a) After the expiration of one year from the date of entry into force of a recommendation adopted under paragraph 1 of Article 5, paragraph 1 of Article 8 or paragraph 1 of Article 9, any Contracting Party may notify the Commission of the termination of its acceptance of the recommendation and, if that notification is not withdrawn, the recommendation shall cease to be binding on that Contracting Party at the end of one year from the date of notification.

(b) A recommendation which has ceased to be binding on a Contracting Party shall cease to be binding on any other Contracting Party 30 days after the date on which the latter notifies the Commission of the termination of its acceptance of the recommendation.

2. In the case of recommendations adopted under paragraph 1 of Article 6, paragraph 2 of Article 8 or paragraph 2 of Article 9, only the Contracting Party exercising fisheries jurisdiction in the area in question may notify the Commission of termination of its acceptance of the recommendation, in which event it shall cease to be binding on any Contracting Party at the end of 90 days from the date of the notification.

3. The Commission shall notify the Contracting Parties of any notification under this Article immediately upon the receipt thereof.

Article 14

1. In the interest of the optimal performance of the functions set out in Articles 4, 5 and 6, the Commission shall seek information and advice from the International Council for the Exploration of the Sea. Such information and advice shall be sought on matters related to the Commission's activities and falling within the competence of the Council, including information and advice on the biology and population dynamics of the fish species concerned, the state of the fish stocks, the effect of fishing on those stocks, and measures for their conservation and management.

2. In order to facilitate the tasks of the International Council for the Exploration of the Sea in providing information and advice to the Commission, the Commission shall seek to establish, in cooperation with the Council, arrangements to ensure that research studies for this purpose, including joint studies, are encouraged and conducted efficiently and without undue delay.

3. The Commission may establish working arrangements with any other international organization which has related objectives.

Article 15

1. Without prejudice to the rights of Contracting Parties in regard to waters under their fisheries jurisdiction, the Contracting Parties shall take such action, including the imposition of adequate sanctions for infractions, as may be necessary to make effective the provisions of this Convention and to implement any recommendation which becomes binding under Article 12.

2. Each Contracting Party shall transmit to the Commission an annual statement of the actions it has taken pursuant to paragraph 1.

Article 16

1. Each Contracting Party shall inform the Commission of its legislative measures and of any agreements which it may have concluded, in so far as those measures and agreements relate to the conservation and utilization of fishery resources in the Convention area.

2. Each Contracting Party shall furnish on the request of the Commission any available scientific and statistical information needed for the purposes of this Convention and such additional information as may be required under Article 9.

Article 17

1. Each Contracting Party shall pay the expenses of its own delegation to all meetings held under this Convention.

2. At its first meeting the Commission shall adopt a budget for its first financial year. At this meeting the Commission may also, as appropriate, adopt a budget for the second financial year.

3. At each annual session the Commission shall adopt a budget for the following financial year and a budget estimate for the financial year following thereafter. A draft budget and draft budget estimate shall be submitted by the President of the Commission to the Contracting Parties not less than 40 days before the meeting of the Commission at which they are to be considered.

4. The Commission shall determine the contributions due from each Contracting Party under the annual budgets according to the following formula: (a) one-third of the budget shall be divided equally among the Contracting Parties;

(b) two-thirds of the budget shall be divided among the Contracting Parties in proportion to their nominal catches in the Convention area, on the basis of the International Council for the Exploration of the Sea definitive catch statistics for the calendar year ending not more than 24 and not less than 18 months before the beginning of the budget year;

(c) however, the annual contribution of any Contracting Party which has a population of less than 300 000 inhabitants shall be limited to a maximum of 5 % of the total budget. When this contribution is so limited, the remaining part of the budget shall be divided among the other Contracting Parties in accordance with subparagraphs (a) and (b). This rule shall be effective for the first five budget years of the Commission and thereafter it shall be subject to annual review by the Commission which may change it by a decision adopted by a three-fourths majority of all Contracting Parties.

5. The Commission shall notify each Contracting Party of the contribution due from that Party as determined under paragraph 4 and of the date as determined by the Commission by which this contribution shall be paid.

6. The contribution of a Contracting Party which has acceded to this Convention during the course of a financial year shall, in respect of that year, be a part proportional to the number of complete months remaining in the year of the annual contribution calculated in accordance with paragraph 4.

7. Contributions shall be payable in the currency of the country in which the office of the Commission is located.

8. A Contracting Party which has not paid by the date determined by the Commission its contributions for two years shall not enjoy the right of casting votes and of making objections under this Convention until it has fulfilled its obligations, unless, at the request of the Contracting Party concerned, the Commission decides otherwise.

9. The Commission shall adopt rules for the conduct of its financial affairs.

Article 18

By a qualified majority the Commission may subdivide the Convention area into regions and may alter the boundaries and vary the number of regions provided that the decision receives the affirmative vote of each Contracting Party exercising fisheries jurisdiction in any part of the area affected.

Article 19

1. Any Contracting Party may propose amendments to this Convention. Any such proposed amendment shall be sent to the Secretary at least 90 days prior to the meeting at which the Contracting Party proposes it to be acted upon. The Secretary shall transmit the proposal immediately to the Contracting Parties.

2. The adoption of a proposed amendment requires a three-fourths majority of all Contracting Parties. The text of any proposed amendment so adopted shall be transmitted by the Commission to the Depositary which shall forthwith forward it to the Contracting Parties.

3. An amendment shall take effect for the Contracting Parties 120 days following the date of the notification by the Depositary of receipt of written notification of approval by three-fourths of all Contracting Parties, unless any other Contracting Party notifies the Depositary, within 90 days of the date of the notification by the Depositary of such receipt, that it objects to the amendment, in which case the amendment shall not take effect for any Contracting Party. A Contracting Party which has objected to an amendment may at any time withdraw its objection. If all objections to an amendment are withdrawn, the amendment shall take effect for the Contracting Parties 120 days following the date of the notification by the Depositary of receipt of the last withdrawal.

4. A Party which ratifies, accepts, approves or accedes to this Convention after an amendment has been adopted in accordance with paragraph 2 shall be deemed to have approved the said amendment.

5. The Depositary shall promptly notify the Contracting Parties of the receipt of notifications of approval of amendments, the receipt of notification of objection or withdrawal of objections, and the entry into force of amendments.

Article 20

1. This Convention shall be open for signature from 18 November 1980 to 28 February 1981 by the following Parties : Bulgaria, Cuba, Denmark in respect of the Faroe Islands, the European Economic Community, Finland, the German Democratic Republic, Iceland, Norway, Poland, Portugal, Spain, Sweden and the Union of Soviet Socialist Republics. It shall be ratified, accepted, or approved as soon as possible and the instruments of ratification, acceptance or approval shall be deposited with the Government of the United Kingdom of Great Britain and Northern Ireland, referred to in this Convention as "the Depositary".

2. This Convention shall enter into force upon the deposit of instruments of ratification, acceptance or approval by not less than seven signatories, provided that these include at least three signatories exercising fisheries jurisdiction within the Convention area. If, however, this Convention has not entered into force one year from the date on which this Convention is opened for signature, but not less than five signatories have deposited instruments of ratification, acceptance or approval, including at least three signatories exercising fisheries jurisdiction within the Convention area, these signatories may agree among themselves, by special protocol on the date on which this Convention shall enter into force ; in that case this Convention shall enter into force with respect to any Party that ratifies, accepts or approves thereafter on the date of deposit of its instrument of ratification, acceptance or approval.

3. Any of the Parties referred to in paragraph 1 which has not signed this Convention may accede thereto at any time after it has entered into force in accordance with paragraph 2.

4. Any state not referred to in paragraph 1, except a Member State of the European Economic Community, may accede to this Convention at any time after it has entered into force in accordance with paragraph 2, provided that an application for accession of that State meets with the approval of three-fourths of all the Contracting Parties.

An application for accession shall be addressed in writing to the Depositary which shall notify all Contracting Parties thereof. The application is approved if within 90 days from the date of such notification three-fourth of all the Parties in respect of which this Convention has already entered into force by that date have notified the Depositary of their approval of the application.

The Depositary shall notify the State applying for accession and all Contracting Parties of the result of the application.

5. Accession shall be effected by the deposit of an instrument of accession with the Depositary and shall take effect on the date of its receipt. As from that date any Party which accedes to this Convention shall be bound by the recommendations which are, at the time of its accession, binding on all the other Contracting Parties as well as by any other recommendations which are, at that time, binding on one or more of the Contracting Parties and are not specifically excluded by the acceding Party in its instrument of accession.

6. The Depositary shall inform all signatories and all acceding Parties of all instruments of ratification, acceptance, approval or accession deposited, and shall notify signatories of the date and the Parties in respect of which this Convention enters into force.

7. The Depositary shall call the first meeting of the Commission as soon as practicable after the entry into force of this Convention and shall communicate the provisional agenda to each Contracting Party.

Article 21

At any time after two years from the date on which this Convention has entered into force with respect to a Contracting Party, that Party may denounce the Convention by means of a notification in writing addressed to the Depositary. Any such denunciation shall take effect twelve months after the date of its receipt, and shall be notified to the Contracting Parties by the Depositary.

Article 22

This Convention, of which the English and French texts are equally authentic, shall be deposited with the Government of the United Kingdom of Great Britain and Northern Ireland. The Depositary shall transmit duly certified copies to the signatories and acceding Parties, and shall register the Convention in accordance with Article 102 of the Charter of the United Nations.

CONVENTION sur la future coopération multilatérale dans les pêches de l'Atlantique du Nord-Est

LES PARTIES CONTRACTANTES,

NOTANT que les États côtiers de l'Atlantique du Nord-Est ont, conformément aux principes pertinents du droit international, étendu leur juridiction sur les ressources biologiques de leurs eaux adjacentes jusqu'à des limites situées à, au plus, deux cents milles marins des lignes de base à partir desquelles la largeur de la mer territoriale est mesurée et qu'ils exercent dans ces zones des droits souverains d'exploration, d'exploitation, de conservation et de gestion desdites ressources,

PRENANT EN CONSIDÉRATION les travaux de la troisième conférence des Nations unies sur le droit de la mer dans le domaine des pêches,

DÉSIRANT PROMOUVOIR la conservation et l'utilisation optimale des ressources halieutiques de l'Atlantique du Nord-Est dans un cadre conforme au régime d'extension de la juridiction de l'État côtier sur les pêches et encourager en conséquence la coopération et la consultation internationales à l'égard desdites ressources,

CONSIDÉRANT que la convention sur les pêcheries de l'Atlantique du Nord-Est du 24 janvier 1959 doit être remplacée en conséquence,

SONT CONVENUES DE CE QUI SUIT:

Article premier

1. La zone à laquelle s'applique la présente convention, ci-après dénommée «zone de la convention», comprend les eaux: a) des parties des océans Atlantique et Arctique et de leurs mers dépendantes, situées au nord de 36º de latitude nord et entre 42º de longitude ouest et 51º de longitude est, mais à l'exclusion: i) des parties de la mer Baltique et des Belts situées au sud et à l'est de lignes reliant Hasenore Head à Gniben Point, Korshage à Spodsbierg et Gilbierg Head à Kullen, et

ii) des parties de la mer Méditerranée et de ses mers dépendantes jusqu'au point d'intersection du parallèle de 36º de latitude et du méridien de 5º 36' de longitude ouest,

b) de la partie de l'océan Atlantique située au nord de 59º de latitude nord et entre 44º de longitude ouest et 42º de longitude ouest.

2. La présente convention s'applique à toutes les ressources halieutiques de la zone de la convention, à l'exception des mammifères marins, des espèces sédentaires, c'est-à-dire les organismes qui, au stade de l'exploitation, sont soit immobiles au fond de la mer ou sous le fond de la mer, soit incapables de se déplacer sauf en restant constamment en contact avec le fond ou le sous-sol de la mer, et, dans la mesure où elles font l'objet d'autres accords internationaux, des espèces hautement migratoires et des stocks anadromes.

Article 2

Aucune disposition de la présente convention n'est réputée porter atteinte aux droits, prétentions ou vues d'une partie contractante en ce qui concerne les limites ou l'étendue de la juridiction en matière de pêche.

Article 3

1. Aux fins de la présente convention, les parties contractantes conviennent de créer et d'administrer une commission des pêches de l'Atlantique du Nord-Est, ci-après dénommée «commission».

2. La commission a la personnalité juridique et jouit, dans ses relations avec d'autres organisations internationales et sur les territoires des parties contractantes, de la capacité juridique nécessaire à l'exécution de ses fonctions et à la réalisation de ses objectifs.

3. Chaque partie contractante nomme à la commission au plus deux représentants, qui peuvent être accompagnés d'experts et de conseillers à toute réunion de la commission.

4. La commission élit son président et au plus deux vice-présidents.

5. La commission a son siège à Londres.

6. À moins qu'elle n'en décide autrement, la commission se réunit une fois par an à Londres à une date de son choix, étant entendu qu'à la demande d'une partie contractante, appuyée par trois autres parties contractantes, le président convoque aussitôt que possible une réunion au moment et à l'endroit de son choix.

7. La commission nomme un secrétaire et tout autre collaborateur dont elle considère avoir besoin.

8. La commission peut mettre sur pied les comités et autres organismes subordonnés dont elle considère avoir besoin pour s'acquitter de ses fonctions et obligations.

9. Chaque partie contractante dispose d'une voix au sein de la commission. Les décisions de la commission sont prises à la majorité simple ou, si la présente convention prévoit expressément une majorité qualifiée, à la majorité des deux tiers des votes de toutes les parties contractantes présentes et votant par l'affirmative ou la négative, étant entendu qu'il ne peut y avoir de mise aux voix sans un quorum des deux tiers des parties contractantes. En cas de partage des voix sur toute matière soumise à une décision prise à la majorité simple, la proposition est réputée rejetée.

10. Sous réserve des dispositions du présent article, la commission arrête son règlement intérieur, y compris les dispositions relatives à l'élection du président et des vice-présidents et à la durée de leur mandat.

11. Des rapports concernant les délibérations de la Commission sont transmis aussitôt que possible aux parties contractantes en anglais et en français.

Article 4

1. La commission exerce ses fonctions dans l'intérêt de la conservation et de l'utilisation optimale des ressources halieutiques de la zone de la convention et tient compte des informations scientifiques les plus pertinentes dont elle puisse disposer.

2. La commission sert de tribune de consultation et d'échange de données sur l'état des ressources halieutiques de la zone de la convention et sur les politiques de gestion, y compris l'examen de l'effet global de ces politiques sur les ressources halieutiques.

Article 5

1. La commission formule, si nécessaire, des recommandations concernant des activités de pêche pratiquées au-delà des zones placées sous la juridiction de pêche des parties contractantes. Ces recommandations sont adoptées à la majorité qualifiée.

2. Dans l'exercice des fonctions décrites au paragraphe 1, la commission s'efforce d'assurer la compatibilité entre: a) toute recommandation s'appliquant à un stock ou groupe de stocks de poisson évoluant aussi bien dans une zone placée sous la juridiction de pêche d'une partie contractante qu'au-delà, ou toute recommandation qui, du fait de l'interdépendance des espèces, aurait une incidence sur un stock ou groupe de stocks de poisson évoluant en totalité ou en partie dans une zone placée sous la juridiction de pêche d'une partie contractante, et

b) toutes mesures et décisions relatives à la gestion et à la conservation dudit stock ou groupe de stocks de poisson prises par cette partie contractante à l'égard des activités de pêche pratiquées dans la zone placée sous sa juridiction en la matière.

La partie contractante en question et la commission facilitent en conséquence la coordination de ces recommandations, mesures et décisions.

3. Aux fins du paragraphe 2, chaque partie contractante informe la commission de ses mesures et décisions.

Article 6

1. La commission peut formuler des recommandations concernant des activités de pêche pratiquées dans une zone placée sous la juridiction de pêche d'une partie contractante, à condition que la partie contractante en question le demande et que la recommandation fasse l'objet d'un vote affirmatif de sa part.

2. La commission peut donner des avis concernant des activités de pêche visées au paragraphe 1, si la partie contractante en question le demande.

Article 7

Dans l'exercice des fonctions décrites aux articles 5 et 6, la commission peut étudier, entre autres, les mesures destinées à: a) la réglementation des engins et appareils de pêche, y compris la dimension des mailles des filets;

b) la réglementation des tailles limites du poisson qui peut être gardé à bord des navires ou débarqué ou exposé ou mis en vente;

c) l'établissement de périodes et zones d'interdiction;

d) l'amélioration et l'augmentation des ressources halieutiques, y compris la propagation artificielle, la transplantation d'organismes et la transplantation de jeunes poissons;

e) la fixation de prises totales autorisées et leur attribution aux parties contractantes;

f) la réglementation du volume de l'effort de pêche et son attribution aux parties contractantes.

Article 8

1. La commission peut, à la majorité qualifiée, formuler des recommandations sur des mesures de contrôle relatives aux activités de pêche pratiquées au-delà des zones placées sous la juridiction de pêche des parties contractantes afin d'assurer l'application de la présente convention et de toute recommandation adoptée en vertu de celle-ci.

2. La commission peut aussi formuler des recommandations sur des mesures de contrôle relatives aux activités de pêche pratiquées dans une zone placée sous la juridiction de pêche d'une partie contractante, à condition que la partie contractante en question le demande et que la recommandation fasse l'objet d'un vote affirmatif de sa part.

3. Les recommandations adoptées en vertu du présent article peuvent comporter des dispositions relatives à leur expiration différentes de celles prévues à l'article 13.

Article 9

1. La commission peut, à la majorité qualifiée, formuler des recommandations en vue de la collecte d'informations statistiques relatives aux activités de pêche pratiquées au-delà des zones placées sous la juridiction de pêche des parties contractantes.

2. La commission peut aussi formuler des recommandations en vue de la collecte d'informations statistiques relatives aux activités de pêche pratiquées dans une zone placée sous la juridiction de pêche d'une partie contractante, à condition que la recommandation fasse l'objet d'un vote affirmatif de cette partie contractante.

Article 10

Lorsqu'elle adopte des recommandations, la commission détermine si, et dans quelles conditions, ces recommandations s'appliquent aux opérations de pêche menées uniquement à des fins de recherches scientifiques effectuées conformément aux principes et règles pertinents du droit international.

Article 11

1. La commission notifie sans retard aux parties contractantes les recommandations qu'elle adopte en vertu de la présente convention.

2. La commission peut publier ou diffuser par d'autres moyens des rapports concernant ses activités et d'autres informations concernant les activités de pêche pratiquées dans la zone de la convention.

Article 12

1. Une recommandation devient obligatoire pour les parties contractantes sous réserve des dispositions du présent article et entre en vigueur à une date fixée par la commission, qui se situera au plus tôt trente jours après la date d'expiration de la période ou des périodes de présentation des objections prévues au présent article.

2. a) Toute partie contractante peut, dans un délai de cinquante jours à compter de la notification d'une recommandation adoptée en vertu du paragraphe 1 de l'article 5, du paragraphe 1 de l'article 8 ou du paragraphe 1 de l'article 9, présenter une objection à cette recommandation. Dans ce cas, toute autre partie contractante peut de la même manière présenter une objection dans les quarante jours suivant la réception de la notification de cette objection. Si une objection est présentée durant cette période supplémentaire de quarante jours, les autres parties contractantes disposent d'une période finale de quarante jours suivant la réception de la notification de cette objection, au cours de laquelle elles peuvent présenter des objections.

b) Une recommandation ne devient pas obligatoire pour une partie contractante qui a présenté une objection à cette recommandation.

c) Si trois parties contractantes ou plus ont présenté une objection à une recommandation, celle-ci ne devient obligatoire pour aucune partie contractante.

d) À moins qu'une recommandation ne soit obligatoire pour aucune partie contractante conformément à l'alinéa c), une partie contractante qui a présenté une objection peut la retirer à tout moment ; la recommandation devient alors obligatoire pour elle dans les soixante-dix jours ou à compter de la date fixée par la Commission en vertu du paragraphe 1, selon l'expiration la plus tardive.

e) Si une recommandation n'est obligatoire pour aucune partie contractante, deux parties contractantes ou plus peuvent cependant convenir entre elles à tout moment d'y donner effet, auquel cas elles en font immédiatement notification à la commission.

3. Dans le cas d'une recommandation adoptée en vertu du paragraphe 1 de l'article 6, du paragraphe 2 de l'article 8 ou du paragraphe 2 de l'article 9, seule la partie contractante exerçant une juridiction en matière de pêche dans la zone en question peut, dans les soixante jours qui suivent la notification de la recommandation, présenter une objection à cette recommandation, auquel cas la recommandation ne deviendra obligatoire pour aucune partie contractante.

4. La Commission notifie dès réception aux parties contractantes toute présentation d'objection et tout retrait d'objection et notifie également la date d'entrée en vigueur de toute recommandation et la date de prise d'effet de tout accord intervenu en application de l'alinéa e) du paragraphe 2.

Article 13

1. a) Un an après la date d'entrée en vigueur d'une recommandation adoptée en vertu du paragraphe 1 de l'article 5, du paragraphe 1 de l'article 8 ou du paragraphe 1 de l'article 9, toute partie contractante peut notifier à la commission sa décision de ne plus accepter la recommandation et, si cette notification n'est pas retirée, la recommandation cesse d'être obligatoire pour cette partie contractante un an après la date de la notification.

b) Une recommandation qui a cessé d'être obligatoire pour une partie contractante cesse d'être obligatoire pour toute autre partie contractante trente jours après la date à laquelle cette dernière notifie à la commission sa décision de ne plus accepter la recommandation.

2. Dans le cas des recommandations adoptées en vertu du paragraphe 1 de l'article 6, du paragraphe 2 de l'article 8 ou du paragraphe 2 de l'article 9, seule la partie contractante exerçant une juridiction en matière de pêche dans la zone en question peut notifier à la commission sa décision de ne plus accepter la recommandation ; dans ce cas, la recommandation cesse d'être obligatoire pour toute partie contractante, au terme d'une période de quatre-vingt-dix jours à compter de la date de la notification.

3. La Commission notifie aux parties contractantes toute notification en vertu du présent article dès réception de cette notification.

Article 14

1. Dans l'intérêt de l'exercice optimal des fonctions décrites aux articles 4, 5 et 6, la commission recueille des informations et des avis auprès du Conseil international pour l'exploration de la mer. Ces informations et avis sont recueillis dans des matières relatives aux activités de la commission et qui relèvent de la compétence du Conseil, y compris les informations et avis sur la biologie et la dynamique de la population des espèces de poisson concernées, l'état des stocks de poisson, l'incidence de la pêche sur ces stocks ainsi que les mesures pour leur conservation et leur gestion.

2. En vue de faciliter les tâches du Conseil international pour l'exploration de la mer en ce qui concerne les informations et avis fournis à la Commission, celle-ci s'efforce de prendre, en coopération avec le Conseil, des dispositions visant à encourager et mener efficacement et dans les meilleurs délais des études de recherche à cette fin, y compris des études communes.

3. La commission peut fixer des modalités de collaboration avec toute autre organisation internationale poursuivant des objectifs connexes.

Article 15

1. Sans préjudice des droits des parties contractantes en ce qui concerne les eaux placées sous leur juridiction en matière de pêche, les parties contractantes prennent les mesures nécessaires, y compris l'imposition de sanctions adéquates en cas d'infraction, pour donner effet aux dispositions de la présente convention et appliquer les recommandations qui deviennent obligatoires aux termes de l'article 12.

2. Chaque partie contractante transmet à la commission un compte rendu annuel des mesures qu'elle a prises conformément au paragraphe 1.

Article 16

1. Chaque partie contractante informe la Commission des mesures législatives qu'elle a prises et de tout accord qu'elle a conclu, pour autant que ces mesures et accords se rapportent à la conservation et l'utilisation des ressources halieutiques dans la zone de la convention.

2. Chaque partie contractante fournit, à la demande de la commission, toutes informations scientifiques et statistiques disponibles requises aux fins de la présente convention, ainsi que les informations complémentaires pouvant être nécessaires aux fins de l'article 9.

Article 17

1. Chaque partie contractante assume les frais de sa propre délégation à toutes les réunions tenues en vertu de la présente convention.

2. Lors de sa première réunion, la commission adopte le budget de son premier exercice financier. Lors de cette réunion, la commission peut également, si nécessaire, adopter le budget du second exercice financier.

3. Lors de chaque session annuelle, la commission adopte le budget de l'exercice financier suivant ainsi qu'un avant-projet de budget pour l'exercice ultérieur. Le projet de budget et l'avant-projet de budget sont soumis par le président de la commission aux parties contractantes au plus tard quarante jours avant la réunion de la Commission au cours de laquelle ils doivent être examinés.

4. La commission fixe la contribution de chaque partie contractante aux budgets annuels selon la formule suivante: a) un tiers du budget est divisé également entre les parties contractantes;

b) deux tiers du budget sont divisés entre les parties contractantes au prorata de leurs prises nominales dans la zone de la convention, sur la base des statistiques de prises définitives du Conseil international pour l'exploration de la mer relatives à l'année civile se terminant au plus tôt 24 mois et au plus tard 18 mois avant le début de l'année budgétaire;

c) toutefois, la contribution annuelle de toute partie contractante ayant une population de moins de 300 000 habitants est limitée à 5 % au maximum du budget total. En cas de limitation de la contribution, la partie restante du budget est divisée entre les autres parties contractantes conformément aux dispositions des alinéas a) et b). Cette règle s'applique pour les premières cinq années budgétaires de la commission ; par la suite, elle fera l'objet d'une révision annuelle par la commission, qui peut la modifier par une décision adoptée à la majorité des trois quarts de toutes les parties contractantes.

5. La commission notifie à chaque partie contractante sa contribution, calculée conformément au paragraphe 4, ainsi que la date, fixée par la commission, à laquelle la contribution doit être versée.

6. Une partie contractante qui a adhéré à la présente convention au cours d'un exercice financier verse pour cet exercice une partie de la contribution annuelle calculée aux termes du paragraphe 4, qui est proportionnelle au nombre de mois complets qui restent dans l'exercice.

7. Les contributions sont payables dans la monnaie du pays où la commission a son siège.

8. Une partie contractante qui n'a pas versé, à la date fixée par la commission, ses contributions pendant deux années se voit privée du droit de voter et de présenter des objections au titre de la présente convention jusqu'à ce qu'elle ait rempli ses obligations, à moins que, à la demande de la partie contractante concernée, la Commission n'en décide autrement.

9. La commission arrête les règles relatives à la conduite de ses opérations financières.

Article 18

À la majorité qualifiée, la Commission peut subdiviser la zone de la convention en régions et peut modifier les limites et le nombre des régions, à condition que la décision fasse l'objet d'un vote affirmatif de chaque partie contractante exerçant une juridiction de pêche dans toute partie de la zone visée.

Article 19

1. Toute partie contractante peut proposer des amendements à la présente convention. Tout projet d'amendement est adressé au secrétaire au moins quatre-vingt-dix jours avant la réunion lors de laquelle la partie contractante propose qu'il soit statué sur ledit projet. Le secrétaire transmet le projet d'amendement immédiatement aux parties contractantes.

2. Les projets d'amendement à la présente convention sont adoptés à la majorité des trois quarts de toutes les parties contractantes. Le texte de tout projet d'amendement ainsi adopté est transmis par la commission au dépositaire, qui le communique immédiatement aux parties contractantes.

3. Un amendement prend effet pour les parties contractantes cent vingt jours après la date de la notification, par le dépositaire, de la réception de la notification écrite d'approbation de l'amendement par les trois quarts de toutes les parties contractantes, à moins qu'une autre partie contractante ne notifie au dépositaire son objection à l'amendement dans les quatre-vingt-dix jours suivant la date de la notification, par le dépositaire, de ladite réception, auquel cas l'amendement ne prend effet pour aucune partie contractante. Toute partie contractante ayant présenté une objection à un amendement peut la retirer en tout temps. Si toutes les objections sont retirées, l'amendement prend effet pour les parties contractantes cent vingt jours après la date de la notification, par le dépositaire, de la réception du dernier retrait.

4. Toute partie qui ratifie, accepte, approuve la présente convention ou y adhère après l'adoption d'un amendement conformément au paragraphe 2 est réputée avoir approuvé cet amendement.

5. Le dépositaire notifie sans retard aux parties contractantes la réception des notifications d'approbation des amendements, la réception des notifications d'objection ou de retrait d'objection, ainsi que l'entrée en vigueur des amendements.

Article 20

1. La présente convention est ouverte du 18 novembre 1980 au 28 février 1981 à la signature des parties suivantes : la Bulgarie, Cuba, le Danemark en ce qui concerne les îles Féroé, la Communauté économique européenne, la Finlande, la République démocratique allemande, l'Islande, la Norvège, la Pologne, le Portugal, l'Espagne, la Suède et l'Union des républiques socialistes soviétiques. La présente convention est soumise à ratification, acceptation ou approbation aussitôt que possible et les instruments de ratification, d'acceptation ou d'approbation sont déposés auprès du gouvernement du Royaume-Uni de Grande-Bretagne et d'Irlande du Nord, dénommé dans la présente convention «le dépositaire».

2. La présente convention entre en vigueur lors du dépôt des instruments de ratification, d'acceptation ou d'approbation d'au moins sept signataires, dont trois au moins exercent une juridiction de pêche dans la zone de la convention. Toutefois, si la présente convention n'est pas entrée en vigueur un an après qu'elle a été ouverte à la signature, mais qu'au moins cinq signataires, dont trois au moins exercent une juridiction de pêche dans la zone de la convention, ont déposé les instruments de ratification, d'acceptation ou d'approbation, ces signataires peuvent convenir entre eux, par un protocole spécial, de la date à laquelle la présente convention entre en vigueur ; dans ce cas, la présente convention entre en vigueur, pour toute partie qui ratifie, accepte ou approuve la convention ultérieurement, à la date du dépôt de son instrument de ratification, d'acceptation ou d'approbation.

3. Toute partie visée au paragraphe 1 qui n'a pas signé la présente convention peut y adhérer à tout moment après l'entrée en vigueur de celle-ci, conformément au paragraphe 2.

4. Tout État non visé au paragraphe 1, à l'exception d'un État membre de la Communauté économique européenne, peut adhérer à la présente convention à tout moment après l'entrée en vigueur de celle-ci conformément au paragraphe 2, à condition qu'une demande d'adhésion de cet État soit approuvée par une majorité des trois quarts de toutes les parties contractantes.

La demande d'adhésion est adressée par écrit au dépositaire qui la notifie à toutes les parties contractantes. La demande est approuvée si, dans les quatre-vingt-dix jours qui suivent la date de cette notification, les trois quarts de toutes les parties à l'égard desquelles la présente convention est déjà entrée en vigueur à cette date ont notifié au dépositaire l'approbation de la demande.

Le dépositaire notifie à l'État qui demande l'adhésion et à toutes les parties contractantes le résultat de la demande.

5. L'adhésion est effectuée par le dépôt d'un instrument d'adhésion auprès du dépositaire et prend effet à la date de sa réception par le dépositaire. À compter de cette date, toute partie adhérant à la présente convention sera liée par les recommandations qui sont, à la date de son adhésion, obligatoires pour toutes les autres parties contractantes ainsi que par toutes autres recommandations qui sont, à cette date, obligatoires pour une ou plusieurs parties contractantes et ne sont pas expressément exclues par la partie adhérente dans son instrument d'adhésion.

6. Le dépositaire informe tous les signataires et toutes les parties adhérentes du dépôt des instruments de ratification, d'acceptation, d'approbation ou d'adhésion et notifie aux signataires la date ainsi que les parties pour lesquelles la présente convention entre en vigueur.

7. Le dépositaire convoque la première réunion de la Commission aussitôt que possible après l'entrée en vigueur de la présente convention et communique l'ordre du jour provisoire à chaque partie contractante.

Article 21

Deux ans au plus tôt après l'entrée en vigueur de la présente convention pour une partie contractante, celle-ci peut dénoncer la convention moyennant une notification écrite à cet effet au dépositaire. Cette dénonciation prend effet douze mois après la date de sa réception et est notifiée aux parties contractantes par le dépositaire.

Article 22

La présente convention, dont les textes en langues anglaise et française font également foi, est déposée auprès du gouvernement du Royaume-Uni de Grande-Bretagne et d'Irlande du Nord. Le dépositaire en transmet des copies certifiées conformes aux signataires et aux parties adhérentes et enregistre la convention conformément à l'article 102 de la Charte des Nations unies.
