AGREEMENT in the form of an exchange of letters between the European Economic Community and the Kingdom of Norway relating to the Agreement on fisheries between the European Economic Community and the Kingdom of Norway

Oporto, 2 May 1992.

Sir,

The establishment of the European Economic Area has given the Community and Norway the opportunity to develop their cooperation in the fisheries sector.

In this connection I confirm that:

- the Norwegian party declares its firm objective to seek, through appropriate and efficient management measures, to reach a long term maximum sustainable TAC on a level of the historic mean of some 600 000 to 700 000 tonnes of Arcto Norwegian cod. In view of the growth of the last year classes, this should be reached in 1997,

- Norway notes that the Community in 1991, under the bilateral Agreement on fisheries between the Community and Norway, has been allocated a quota of 4 600 tons of Arcto Norwegian cod in the Norwegian economic zone north of 62 degress northern latitude, and that this quota constitutes 2,14 % of the TAC for 1991. Norway undertakes, within the framework of the balanced annual fisheries arrangement, to consolidate the Community's annual quota of Arcto Norwegian cod north of 62 degress northern latitude to 2,9 % of the TAC for the said stock from 1993,

- Norway will also undertake from 1993 to allocate to the Community an additional quota of Arcto Norwegian cod in the Norwegian economic zone north of 62 degrees northern latitude. This quota shall be:

1993: 6 000 tons of cod,

1994: 7 250 tons of cod,

1995: 8 500 tons of cod,

1996: 9 750 tons of cod,

1997: 11 000 tons of cod.

These additional quotas are guaranteed. In consecutive years, Norway accepts that the share of the TAC will be equal to the average of the share of the TAC during the period 1993 to 1997,

- as regards the allocation of these additional quotas of Arcto Norwegian cod, it is recognized that this arrangement calls for adaptations in the quotas available to Norway in the Community zone under the bilateral Agreement on fisheries between the Community and Norway. In this connection, Norway takes note that the Community, when proposing such adaptations, will take due account of the need of the Community to accord, as appropriate, due priority to the catch requirements of Community vessels for key stocks in its own waters. The quotas of stocks to be attributed to Norway under this arrangement will primarily have to be found in Community waters outside ICES - area IV.

- Norway undertakes to continue on a permanent basis to allocate, also after 1 January 1993, an additional quota of 1 500 tonnes of redfish to the Community in the Norwegian economic zone north of 62 degrees northern latitude, outside the fisheries balance between the Parties,

- in the event of abrupt changes in the stocks, these arrangements will be reviewed by the Parties,

- this exchange of letters shall be approved by the Contracting Parties in accordance with their own procedures, and shall take effect on the same date as the Agreement on the European Economic Area (EEA) enters into force for Norway.

I have the honour to acknowledge receipt of your letter of today's date which reads as follows:
